2001-191NOTE Amended by Ordinance No 2001-453 ORDINANCE NO JW-,1 1 AN ORDINANCE OF THE CITY OF DENTON, TEXAS TO PROVIDE FOR A ZONING PLAN FOR APPROXIMATELY 22 ACRES LOCATED WITHIN AN AGRICULTURE (A) ZONING DISTRICT, TO CHANGE TO MULTI-FAMILY CONDITIONED (MF[c]) DISTRICT TO ALLOW FOR MULTI-FAMILY USES, THE SUBJECT PROPERTY BEING LOCATED ON THE SOUTH SIDE OF MCKINNEY STREET, APPROXIMATELY 1000' WEST OF LOOP 288, PROVIDING A SAVINGS CLAUSE, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE (ZP-01-0003) WHEREAS, on February 1, 2000, the City Council adopted Ordinance No 2000-046 which established certain residential interim regulations (the "Residential Interim Regulations"), WHEREAS, the Residential Interim Regulations established, among other things, a Zoning Plan requirement in the event of a request to rezone property, and WHEREAS, on March 7, 2001, SENT Corporation, on behalf of Southwest Housing Development, applied for a change in zoning for 22 0 acres of land located on the south side of McKinney Street, approximately 1000' west of Loop 288, from an Agriculture (A) zoning district classification and land use designation to Multi-family conditioned (MF[c]) zoning district classification and land use designation with the intent to develop a multi-family complex with a community center which application includes a Zoning Plan, a copy of which is attached hereto as Exhibit "B" (the Zoning Plan!), and WHEREAS, on April 11, 2001, the Planning and Zoning Commission recommended approval of the requested change in zoning and the Zoning Plan, and WHEREAS, the City Council finds that the Zoning Plan, with the conditions imposed herein, meets the requirements of the Residential Interim Regulations and is consistent with the approved 1999-2020 Denton Comprehensive Plan, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION 1 The zoning district classification and land use designation of the approximately 220 acres property described in the legal description attached hereto and incorporated herein as Exhibit A (the "Property") is changed from Agriculture (A) zoning district classification and land use designation to Multi-family conditioned (MF[c]) zoning district classification and land use designation under the comprehensive zoning ordinance of the City of Denton, Texas to allow a multi-family complex with a community center in accordance with the Zoning Plan The Zoning Plan and said change in zoning are hereby approved, subject to the following conditions 1 All conditions set forth on the Zoning Plan 2 The note regarding roof pitch is amended to reference the surrounding houses, rather than the houses to the east S \Our Plan 6 A collector road, from the subject property to Loop 288, will be provided prior to the issuance of any certificate of occupancy SECTION 2 The City's official zoning map is amended to show the change in zoning district classification SECTION 3 If any provisions or the application thereof to any person or circumstance is held invalid by any court, such invalidity shall not affect the validity of other provisions or applications, and to this end the provisions of this ordinance are severable SECTION 4 Any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000 00 Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense SECTION 5 This ordinance shall become effective fourteen TRANSPORTATION IMPROVEMENTS FOR APPROXIMATELY 22 ACRES OF LAND ZONED MULTI-FAMILY CONDITIONED (MF[C]) AND LOCATED ON THE SOUTH SIDE OF LOOP 288 APPROXIMATELY 1000 FEET WEST OF LOOP 288, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, PROVIDING A SEVERABILITY CLAUSE AND AN EFFECTIVE DATE (ZPO1-0006) WHEREAS, on March 7, 2001, SENT Corporation, on behalf of conditions including the provision of certain transportation improvements, and WHEREAS, Condition No 6 of Section 1 of Ordinance No 2001-191 provides "6 A collector road, from the subject property to Loop 288, will be provided prior to the issuance of any certificate of occupancy" (called "Condition No 6") WHEREAS, on October 1, 2001, Southwest Housing Development applied for a zoning change to amend Ordinance 2001-191, and WHEREAS, on November 14, 2001, the Planning and Zoning Commission concluded a public hearing as required by law, after which it recommended approval of the amendments provided below, and WHEREAS, the City Council finds that the amendments to Ordinance 2001-191 are consistent with the Comprehensive Plan and are in the public interest, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I Condition No 6 in Section 1 of Ordinance 2001-191 is amended to read as follows 6 Two lanes of a collector road from the subject property to Loop 288 will
