AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A ZONING
CHANGE FOR 2400 E UNIVERSITY DRIVE LOCATED WITHIN PLANNED
DEVELOPMENT (PD-14) ZONING DISTRICT, TO CHANGE TO A COMMERCIAL (C)
DISTRICT, THE SUBJECT PROPERTY BEING LOCATED ON THE SOUTH SIDE OF
UNIVERSITY, EAST OF NOTTINGHAM DRIVE AND WEST OF OLD NORTH ROAD,
PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 00 FOR
VIOLATIONS THEREOF, PROVDING A SEVERABILITY CLAUSE AND AN EFFECTIVE
DATE (Z-01-0018)
WHEREAS, Mohammad Yotmls initiated a change in zomng for 2400 E University from
Planned D~velopment (PD- 14) zomng d~stnct classification and use demgnat~on to a Commercial (C)
zoning district classification and use designation, and
WHEREAS, on July 11, 2001, the Planning and Zoning Commission concluded a public
heanng asl reqmred by law and recommended approval of the requested change in zoning, and
WHEREAS, the City Council finds that the cNmge in zoning is consistent with the
Comprehonmve Plan, NOW, THEREFORE,
THE COLrNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SI~CTION 1 The zoning district classification and use designation of 2400 E University
Drive described in the legal description attached hereto and incorporated herein as ExNblt A is
changed from Planned Development (PD-14) zomng district classification and use designation to
Commercial (C) zoning rhstnct classification and use designation under the comprehensive zoning
ordlnanc~ of the City of Denton, Texas
SECTION 2 The City's official zomng map is amended to show the change in zomng
district classification
SECTION 3 If any provmlon of this ordinance or the apphcatlon thereof to any person or
circumstance is held invalid by any court, such invalidity shall not affect the validity of other
provmlon~ or appheatmns, and to this end the provisions of this ordinance are severable
SI~CTION 4 Any person violating any provlmon o fthm ordinance shall, upon convlctlon, be
fined a stWa not exceeding $2,000 00 Each day that a provision of this ordinance is violated shall
constitute a separate and distinct offense
S~CTION 5 That thru ordinance shall become effective fourteen (14) days from the date of
