AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A ZONING
CHANGE FROM OFFICE (O) ZONING DISTRICT CLASSIFICATION AND USE
DESIGNATION TO GENERAL RETAIL WITH CONDITIONS ZON1NG DISTRICT
CLASSIFICATION AND USE DESIGNATION FOR APPROXIMATELY 0 41 ACRE OF LAND
COMMONLY KNOWN AS 1414 ELM STREET GENERALLY LOCATED 150 FEET NORTH
OF THE INTERSECTION OF ELM STREET AND THIRD STREET AND LEGALLY
DESCRIBED AS LOT 3, BLOCK 1, OF THE NORTHSIDE ADDITION, PROVIDING FOR A
PENALTY IN THE MAXIMUM AMOUNT OF $2,000 00 FOR VIOLA rlONS THEREOF,
PROVIDING A SEVERABILITY CLAUSE AND AN EFFECTIVE DATE (Z-01-0014)
WHEREAS, the City of Denton mitmted a change ~n zomng for 0 41 acre of land from Office
(O) zomng district classification and use demgnat~on to General Retail (GR) with conditions zomng
dmtnct classfficat~on and use designation, and
WHEREAS, on June 13, 2001, the Planning and Zoning Commms~on concluded a pubhc
hearing as reqmred by law, after whmh a motion to recommend approval of the requested change ~n
zomng was passed, and
WHEREAS, the C~ty Council finds that the change m zoning ~s consistent w~th the
Comprehensive Plan, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
~ The zomng dmtnct classfficatlon and use deslgnaUon of the 0 41 acre property
described as Lot 3, Block 1, of the Norths~de Addition m changed from Office (O) zomng dmtnct
classfficat~on and use des~gnaUon to General Retail (GR) conditioned zomng d~stnct classfficaUon
and use designation subject to the following conditions
Any new hghtmg shall be designed and malnUuned so as not to sh~ne on or disturb
surrotmdmg res~dentml property or to sh~ne and project upward to prevent d]ffumon m to the
mght sky
SECTION 2 The C~ty's officml zomng map ~s amended to show the change ~n zoning
d~stnct classification
~ if any prows~on of thru ordinance or the apphcat~on thereof to anY pers°n °r
mrcumstanee m held mvahd by any court, such lnvahd~ty shall not affecl the vahdlty of other
provisions or apphcat~ons, and to th~s end the prows~ons of thru ordinance are severable
SECTION 4 Any person wolatmg any provis~on ofthls ordinance shall, upon convict'°n, be
fined a sum not exceeding $2,000 00 Each day that a provision of thru ordinance m wolated shall
consUtute a separate and dmt~nct offense

SECTION 5 That this ordinance shall become effective fourteen (14) days from the date of
its passage, and the C~ty Secretary m hereby directed to cause the caption of th~s ordinance to be
published ~wme in the Denton Record-Chronicle, a daily newspaper published in the City of Denton,
Texas, wltban ten (10) days of the date of its passage
