AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR AN AMENDMENT
TO SUBSECTION 35-7(b)(3)b 1 OF THE CODE OF ORDINANCES OF THE CITY OF
DENTON, TEXAS, TO ELIMINATE THE MANDATORY TIME PERIOD FOR REFERRING A
ZONING CASE FROM THE PLANNING AND ZONING COMMISSION TO THE CITY
COUNCIL AFTER A PLANNING AND ZONING COMMISSION RECOMMENDATION,
PROVIDING A SEVERABILITY CLAUSE AND AN EFFECTIVE DATE (Z-01-0023)
WHEREAS, on July 11,2001, the Planning and Zoning Commission on its own motion aRer
concluding a public hearing as required by law, recommended that Subsection 35-7(b)(3)b 1 of the
Code of Ordinances be amended as heremafier prowded, and
WHEREAS, the C~ty Cotmcfl finds that all notices and public heanngs for this amendment
have been conducted in the Ume and manner required by law, and
WHEREAS, the City Council further finds thas amendment to the C~ty of Denton
Comprehensive Zomng Ordinance is consistent w~th the Comprehensive Plan, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION 1 Subsection 35-7(b)(3)b 1 of the Code of Ordinances of the City is hereby
amended in its entirety to read as follows
1 Recommendatton of approval If the commission recommends approval of the
requested zomng change, such request shall be referred to the council
SECTION 2 If any prowmon of this ordinance or the apphcaUon thereof to any person or
c~rcumstance is held invalid by any court, such mvall&ty shall not affect the val~&ty of other
provisions or applications, and to this end the provisions of this ordinance are severable
SECTION 3 Th~s ordinance shall become effective immediately from and after its passage
and shall apply to all zomng cases pending w~th the C~ty of Denton at the time or,ts passage
