2001-262 O INANCE NO AN ORDINANCE OF THE CITY OF DENTON, TEXAS, APPROVING A SPECIFIC USE PERMIT FOR A MOBILE HOME COMMUNITY ON APPROXIMATELY 23 7 ACRES OF LAND LOCATED AT THE NORTHWEST CORNER OF FORT WORTH DRIVE AND MISSION STREET, WITHIN A LIGHT INDUSTRIAL (LI) ZONING DISTRICT CLASSIFICATION AND USE DESIGNATION, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE (Z-01-0016) WHEREAS, the City of Denton, on behalf of Rene Cassar, has apphed for a specffic use permit for an exmtmg mobile home park on 23 7 acres of land located at the northwest comer of Fort Worth Drive and Mission Street, wlttun a L~ght Industrial (LI) zomng d~stnct classfficatlon and use des~gnatlon, and WHEREAS, on June 27, 2001, the Planmng and Zomng Commission recommended approval ora Specffic Use Permit for a mobile home park, and WHEREAS, the Caty Councd finds that the Specafic Use Permit is consmtent with The Denton Plan, and WHEREAS, an accordance w~th ArUcle III, D~mslon 4, of Chapter 35 of the Code of Ordinances of the City of Denton, Texas, the City Council finds that all of the following condmons exast The specffic use will be compatible with and not lnjunous to the use and enloyment of other property nor sagmficantly dlmlmsh or lmpmr property values within the immediate wclmty, The estabhshmant of the specific use, a mobile home park, wall not impede the normal and orderly development and Improvement of surroundang vacant property, Adequate utflmes, access roads, drainage, and other necessary supporting faethtles have been or will be provided, The demgn, location, and arrangement of all draveways and parking spaces provides for the safe and convement movement of vehmular and pedestrian traffic without adversely affecting the general pubhc or adjacent developments, Adequate nmsance prevention measures have been or will be taken to prevent or control offans~ve odor, fumes, dust, noise, and wbratlon, Directional hghtmg will be provided so as not to disturb or adversely affect ne~ghbonng propemes, PAGE 1 There is sufficient landscaping and screening to ensure harmony and compat~blhty with adjacent property, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION 1 A specific use permit is hereby granted to allow a mobile home park on approximately 23 7 acres of land, consisting of an approximate 21 270 acre tract of land legally described as Tract 58 of the W Darnel Survey, Abstract No 378, and more fully described in that certain warranty recorded under Denton Country Clerk Number 94-0005624 m the Deed Records of Denton County, and an approximate 0 7089 acre tract of land legally descnbed as Tract 59 of the W Daniel Survey, Abstract No 387, and more fully described m that certatn warranty deed recorded under Denton County Clerk Number 94-0005624 m the Deed Records of Denton County, and an approximate 1 73 acre tract of land legally described as Tract 61 of the W Darnel Survey, Abstract No 387, and more fully described ~n that certain tnstmment recorded in Vol 1164, Page 794 of the Deed Records of Denton County Smd 23 7 acre tract ts located at the northwest comer of Fort Worth dnve and Mlssxon Street, watlun a L~ght Industrial (LI) zoning dmtnct classification and use designation The specific use permit and the rote plan attached hereto and tncorporated hereto as Exhibit "A," are hereby approved subject to the followmg condmons 1 The specific use permit wall be tied to the stte plan shown as Exhibit "A" with the followtng modlficatxons lots 16, 26, 32,51 and 57 have been ehm~nated or combtned to tncrease adjacent lot sxzes, and the total number of lots allowed by thxs Specific Use Permit ~s 169 2 New lighting on the property shall be designed and mmnttuned so as not to shtne on or otherwise disturb surrounding res~dentml property or to shxne and project upward to prevent the diffusion ~nto the mght sky SECTION 2 The Ctty's official zomng map xs amended to show the change ~n zoning dmtnct classification SECTION 3 Any person violating any prows~on of tlus ordtnance shall, upon conwct~on, be fined a sum not exceeding $2,000 00 Each day that a prowslon of thru ordinance xs violated shall constitute a separate and dxstlnct offense SECTION 4 Th~s ordinance shall become effective fourteen (14) days from the date of its passage, and the C~ty Secretary is hereby directed to cause the captxon of this ordinance to be published twace m the Denton Record-Chromcle, a dally newspaper pubhshed in the City of Denton, Texas, wittnn ten (10) days of the date of~ts passage EULINE BROCK, MAYOR PAGE 2 ATTEST JENNIFER WALTERS, CITY SECRETARY APPROVED AS TO LEGAL FORM HERBERT L PROUTY, CITY ATTORNEY PAGE 3 EXHIBIT A
