ORDINANCE NO ~
AN ORDINANCE AUTHORIZING THE ACCESS OF CONFIDENTIAL INFORMATION IN
FILES CREATED BY LOCAL GOVERNMENT CODE SECTION 143 089(g) TO THE CITY
MANAGER, ASSISTANT CITY MANAGER FOR PUBLIC SAFETY AND
TRANSPORTATION, HUMAN RESOURCES DEPARTMENT STAFF AND CITY ATTORNEY
AND HIS ASSISTANTS AND ANY ATTORNEY HIRED TO ASSIST THE
AFOREMENTIONED OFFICIALS AND EMPLOYEES, AND PROVIDING FOR AN
EFFECTIVE DATE
WHEREAS, Local Government Code §143 089(g) makes eertmn ~nformat~on confidential
coneermng Pohce and F~refighters departmental personnel files to persons outside the department,
and
WHEREAS, the Attorney General ~n Oplmon $C-0283 has determined that th~s ~nformat~on
~s available to the chief executive officer and govermng body, and
WHEREAS, the Attorney General has also determined that the chief executive officer and
governing body is authorized to designated certain officmls who are allowed to have access to th~s
reformation, and
WHEREAS, the City Council has determined that the C~ty Manager, Assistant C~ty Manager
for Pubhc Safety and Transportatmn, Human Resources Department Staff and the C~ty Attorney and
h~s assistants and any attorney h~red to assist the aforementmned offimals and employees should
have access to th~s ~nformatmn NOW THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEKEBY ORDAINS
SECTION 1 The C~ty Council hereby authorizes that confidentml ~nfonnatmn m
departmental files created under Local Government Code § 143 089(g) can be released to the C~ty
Manager, Asmstant C~ty Manager for Pubhc Safety and Transportation, Human Resources
Department Staff and the C~ty Attorney and his assistants and any attorney h~red to assist the
aforementmned officmls and employees
SECTION 2 This ~nformatmn shall not be d~stnbuted to any nnauthonzed person
SECTION 3 Th~s ordinance shall become effective ~mmedmtely upon ~ts passage and
approval
