DESIGNATION TO PLANNED DEVELOPMENT (PD) ZONING DISTRICT CLASSIFICATION
AND USE DESIGNATION FOR APPROXIMATELY 0 25 ACRES OF LAND LOCATED AT
1604 NORTH ELM STREET, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT
OF $2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE

WHEREAS, the C~ty of Denton, on behalf of Scott Brown, imtaated a change an zomng for
0 25 acres of land from General Retml (GR) zomng district classfficat~on and use designaUon to
Planned Development (PD) zoning d~stnct elassffieat~on and use desxgnatlon, and
WHEREAS, on July 1 l, 2001, the Planmng and Zomng Commmsion recommend approval of
the requested change m zoning, and
WHEREAS, the Caty Council finds that the change an zoning as consistent w~th the 1999-
2020 Comprehensxve Plan, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION 1 The zomng d~stnet classfficataon and use des~gnataon of an approxamate 0 25
acre property located at the northeast comer of North Elm and College Streets, legally described as
parts of Lots 1 and Lots 24 of the Wheeler Addataon, and commonly known as 1604 North Elm
Street xs hereby changed from General Retml (GR) zoning &strict classification and use desagnat~on
to Planned Development (PD) zonmg dastnct classffieatlon and use designation under the
eomprehensave zomng ordinance of the C~ty of Denton, Texas, subject to the following condmons
1 The permxtted land uses are restricted to those described an the last attached hereto and
Incorporated hereto by reference as Exhabat A
2 For the purpose of tins ordinance Exh~bat B shall constitute the Detailed Plan
3 Any new hghting on thas property shall be designed and mmntalned so as not to shane on or
otherwme &sturb surroundang residential property or to sh~ne and project upward to prevent
the diffusion into the mght sky
SECTION 2 The C~ty's officml zomng map as amended to show the change in zoning
&strict classlficaUon
SECTION 3 Any person wolatmg any prowslon of this ordinance shall, upon convactaon,
be fined a sum not exceedang $2,000 00 Each day that a provision of thru or&nance as violated shall

SECTION 5 This ordanance shall become effective fourteen (14) days from the date or,ts
passage, mad the City Secretary is hereby d~reeted to cause the caption of this ordinance to be
published twice an the Denton Re¢ord-Chromcle, a daily newspaper pubhshed m the Caty of Denton,
Texas, within ten (10) days of the date of as passage
