AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A ZONING
CHANGE FROM SINGLE-FAMILY (SF-7) ZONING DISTRICT CLASSIFICATION AND USE
DESIGNATION TO A PLANNED DEVELOPMENT ZONING DISTRICT CLASSIFICATION
AND USE DESIGNATION ALLOWING MULTI-FAMILY USES FOR APPROXIMATELY
1 787 ACRES OF LAND LOCATED AT 1005-1009 WILSON STREET WHICH IS LOCATED
ON THE NORTH SIDE OF WILSON STREET, EAST OF BRADSHAW AND WEST OF
RUDDELL, APPROVING A CONCEPT PLAN, PROVIDING FOR A PENALTY IN THE
MAXIMUM AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, PROViDING A
SEVERABILITY CLAUSE AND AN EFFECTIVE DATE (Z-01-0010)
WHEREAS, Rmhard Franco, on behalf of Denton Houmng Authority ~mtlated a change ~n
zoning for 1 785 acres of land fi.om Single-family (SF-7) zomng dmtnct elassffieanon and use
demgnatlon to Multi-Family (MF-1) zomng district classfficatlon and use demgnaUon, and
WHEREAS, on June 27, 2001 the Planning and Zoning Commission concluded a pubhc
heanng as reqmred by law, and recommended denial of the requested zoning change, and
WHEREAS, the C~ty Council finds that the change in zoning xs eonmstent w~th The Denton
Plan, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION 1 The zoning thstnct clasmficatlon and use deslgnatmn of the 1 787 acre
property described m the legal description attached hereto and incorporated herein as Exhibit A is
changed fi.om S~ngle-famfly (SF-7) zoning district classfficaUon and use designation to Planned
Development zomng dmtnct elasslficatmn and use designation allowing mulu-famfly uses under the
comprehenmve zomng ordinance of the C~ty of Denton, Texas, ~n accordance with the concept plan
attached hereto and incorporated hereto as Exhxb~t B, which concept plan m hereby approved w~th
the following condmon
All remdents shall be 62 years of age or older
SECTION 2 The City's official zomng map is amended to show the change xn zonmg
d~smct clasmficat~on
SECTION 3 If any prowmon of thru ordinance or the apphcatlon thereof to any person or
c~mumstance m held ~nval~d by any court, such mvahd~ty shall not affect the vahd~ty of other
provisions or apphcat~ons, and to thru end the proms~ons of thru ordinance are severable
SECTION 4 Any person wolatmg any prowsion of this orchnance shall, upon conviction, be
fined a sum not exceeding $2,000 00 Each day that a prowsion ofth~s ordinance is violated shall
constitute a separate and distract offense
SECTION 5 That th~s or(hnance shall become effective fourteen (14) days from the date of
its passage, and the C~ty Secretary is hereby directed to cause the caption of th~s ordinance to be
pubhshed twine an the Denton Reeord-Chromele, a daffy newspaper published in the C~ty of Denton,
Texas, w~thm ten (10) days of the date of its passage
