AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR AN AMENDMENT
TO SUBSECTION 35-91 (E)(1) OF THE CODE OF ORDINANCES OF THE CITY OF DENTON,
TEXAS, TO INCREASE THE MAXIMUM BUILDING COVERAGE; PROVIDING A
SERVERABILITY CLAUSE; PROVIDING A CRIMINAL PENALTY NOT TO EXCEED
$2,000.00; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR AN EFFECTIVE
DATE. (SI01-0014)
WHEREAS, the City Council finds that all notices and public heatings for this amendment
have been conducted in the time and manner required by law, and; and
WHEREAS, on August 8, 2001, the Planning and Zoning Commission recommended
approval of the requested zoning amendment; and
WHEREAS, the City Council finds this amendment to the City of Denton Comprehensive
Zoning Ordinance is consistent with the Comprehensive Plan; NOW, THEREFORE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. Subsection 35-91(e)(1) of the Code of Ordinances of the City is hereby
amended in part to replace the Schedule Maximum Building Coverage as follows:

SECTION 2. Any person violating any provision of this ordinance shall, upon conviction, be
fined a sum not exceeding $2,000.00. Each day that a provision of this ordinance is violated shall
constitute a separate and distinct offense.
SECTION 3. If any provision of this ordinance or the application thereof to any person or
circumstance is held invalid by any court, such invalidity shall not affect the validity of other
provisions or applications, and to this end the provisions of this ordinance are severable.
SECTION 4. Save and except as amended hereby, all the sections, subsections, sentences,
clauses, and phrases of Chapter 35 of the Code of Ordinances of the City of Denton shall remain in
full force and effect.
SECTION 5. This ordinance shall become effective fourteen (14) days from the date of its
passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be
published twice in the Denton Record-Chronicle, a daily newspaper published in the City of Denton,
Texas, within ten (10) days of the date of its passage.
