AN ORDINANCE OF THE CITY OF DENTON, TEXAS AMENDING THE SCHEDULE OF
RATES FOR SOLID WASTE SERVICE CONTAINED IN ORDINANCE NUMBERS 2000-297
AS AUTHORIZED BY CHAPTER 24 OF THE CODE OF ORDINANCES OF THE CITY OF
DENTON, TEXAS, PROVIDING THAT THE PROVISIONS OF SECTIONS 26-3, 26-4, 26-5,
26-7, 26~8(a), AND 26-9 OF THE CODE OF ORDINANCES OF THE CITY OF DENTON,
TEXAS SHALL EXPRESSLY APPLY TO CITY OF DENTON SOLID WASTE SERVICE,
AMENDING THE CHARGES FOR RESIDENTIAL SERVICE, INCREASING SERVICE
CHARGES FOR COIvIMERCIAL SIDE LOAD CONTAINER SERVICE, AMENDING THE
CHARGES FOR TEMPORARY CONTAINER SERVICE, AMENDING THE CHARGES FOR
CONTAINER EXTRA SERVICE, PROVIDING FOR 50 CUBIC YARD AND 33 CUBIC
YARD CONTAINER SERVICE, AMENDING THE CHARGES FOR CONTAINER
DELIVERY, RELOCATION, AND INACCESSIBLE CONTAINERS, AMENDING THE CITY
OF DENTON CHARGES FOR THE STATE OF TEXAS DISPOSAL FEE, NOTIFYING
CITIZENS THAT ALL LANDFILL PERMITS ISSUED IN PRIOR YEARS HAVE EXPIRED,
PROVIDING FOR A REPEALER, PROVIDING FOR A SEVERABILITY CLAUSE, AND
PROVIDING FOR AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
~qECTION 1 That the charges for sohd waste collection services as authorized by Section
24-42(b) of Article II, Section 24-66 of Amcle HI and Section 24-4 ofArtmle I of Chapter 24, and
by Section 32-90 of Article IV of Chapter 32 of the Code of Orthnances of the Ctty of Denton,
Texas, are hereby established as follows

Denton's acceptance and disposal of Special Waste as defined by the State of Texas in the
Texas Mumclpal Solid Waste Management Regulations is conchtlonal upon the waste
requested for dmposal Acceptance of special waste is subject to Federal and State laws and
regulations, and the City of Denton has the right to refuse to accept special waste at their
discretion
Special Waste Charge $65 50 per ton
An additional 3 85% fee will be assessed for each tlmrty (30)-day period (excluding rental
charge) to compensate for the State of Texas surcharge for solid waste disposed at landfills
The City staff m hereby authorized to remit such fee to the State, and should the State
Legislature change th~s fee, such change is hereby authorized to be charged and collected

A delivery fee of $45 00 per container will be charged to all customers for Roll-Off
contmners A delivery fee of $35 00 per contmner will be charged to all other customer

A relocataon fee of $35 00 will be charged for each Roll-Off container that is relocated at the
customer's site(s)
A $50 00 fee will be charged for each request for same day pickup service for Roll-Off
customers who receive pickup service upon demand The solid waste Customer Relations
Division must receive notification prior to 10 00 AM on the day service is requested in order
to provide same day pickup service
A fee for inaccessible and unserviceable contmners will be assessed The fee will be $45 00

for roll-off contmners, and $35 00 for all other contmners
A $112 00 fee wall be charged for contmner lock installations provided by the City of Denton
$70 00 will be charged for container lock removal
A fee of $300 00 will be assessed to all Roll-Off customers who have containers whose waste
weighs m excess of 9 tons
A deposat for Demand Response and Temporary Contmners will be charged based upon one-
mxth (1/6) of the estimated annual bfihng amount or servme contract
A mammum of once per week pickup service as reqmred for putresable (food) waste
containers
Up to eaght (8) bulky atems wall be packed up free of charge on the first Thursday of each
month, the monthly commermal bulky atem pickup day, af the customer calls the Customer
Relataons Davlsaon a minimum of 48 hours m advance of the first Thursday Bulky ~tems
shall not be placed near or adjacent to contmners prior to 48 hours before the scheduled first
Thursday paekup A service fee of $35 00 shall be charged, together with an addltaonal fee of
$10 00 per bulky ~tem for each bulky ~tem in excess of eight (8) bulky ~tems In addatlon to
the se~vace fee of $35 00, a $30 00 charge will be assessed for overflowang and excess waste
of up to one cubic yard outsade the container An additional fee of $30 00 for every cubic
yard of sohd waste outsade the contmner up to e~ght (8) cubac yards shall be assessed unless
the sohd waste exceeds eaght (8) cubic yards
There are no fees for the collection of appliances, which do not contmn either polychlonnated
baphenyls (PCB's) or chlorofluorocarbons (CFC's) There are no charges for the collectmn
of apphancas wluch have contained either polychlormated blphenyls (PCB's) or
chlorofluomcarbons (CFC's), af the customer prowdes a certfficate of documentataon from an
approved business qualffied to remove these products indicating that the PCB's and/or CFC's
have been properly removed for disposal For apphances, wluch contmn PCB's and/or
CFC's for wtuch no approved removal documentation is provaded, there will be a $50 00
charge per apphance
Bulky atems and apphances may be dehvered by Denton sohd waste customers to the landfill

All such contracts may contain conditions of operation, dmposal, and dehvery as the C~ty
Manager or bas demgnee shall determine necessary for the efficient operation of the Denton
landfill s~te and the method ofbdhng and collectxon for such use

mformatlon regarding the residency of the individual or the origin of the solid waste
RRCTII3N 't. That It is in the pubhc lntelest that the provisions of Sections 26-3, 26-4, 26-
5, 26-7, 26-8(a), and 26-9 of Article i of Chapter 26 of the City of Denton Code of
Ordinances shall expressly apply to City of Dcnton Solid Waste service

this ordinance became effective which ale inconsistent, or in conflmt with the terms or
provimons contained in th~s or&nance ate hereby repealed to the extent of any such conflict
