AN ORDINANCE OF THE CITY OF DENTON, TEXAS PROVIDING FOR THE
SCHEDULE OF MISCELLANEOUS FEES, DEPOSITS, BILLINGS AND PROCEDURES
FOR ADMINISTRATIVE SERVICES TO CITY CUSTOMERS AND TAXPAYERS
CONTAINED IN ORDINANCE NO 2000-296, AMENDING THE NAME OF THE
ACCOUNT CONNECTION AND RECONNECTION FEES TO THE ACCOUNT
CONNECTION AND RECONNECTION CHARGES, AMENDING THE NAME OF THE
ELECTRIC METER INSTALLATION FEE TO THE ELECTRIC METER INSTALLATION
CHARGE, AMENDING THE NAME OF THE ELECTRIC AND WATER METER
RECONNECTION FEE TO THE ELECTRIC AND WATER METER CONNECTION
CHARGE, AMENDING THE DELINQUENT SERVICE FEE TO THE DELINQUENT
SERVICE CHARGE, AMENDING THE METER READING AND TEST FEES TO THE
METER READING AND TEST CHARGES, AMENDING THE NAME OF THE
INSUFFICIENT FUND CHECK CHARGE TO THE RETURNED PAYMENT CHARGE,
AMENDING THE APPLICATION OF AND THE INTEREST RATE TO THE SERVICE
DEPOSITS PROVISION, WHOLLY DELETING THE CREDIT CARD SERVICE FEE,
ADDING A CREDIT REPORT CHARGE, PROVIDING FOR A REPEALER, PROVIDING
FOR A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION 1 That the schedule of charges for general utility services as generally
provided for in Chapter 26 of the Code of Orchnances, and for services to other C~ty of Denton
customers and taxpayers, are hereby estabhshed as follows

APPLICATION
Applicable when a customer requests electric serwce on a first time basis where no permanent
service previously existed and where a new account number is estabhshed

APPLICATION
Applicable when a customer requests service at an address which has ex~snng or previous
service, with an exlstmg account number and history, and the electric and/or water meter must be
installed or activated for readiness

METER READING AND TEST CHARGES

METER READING
APPLICATION
Applicable to any electric or water utthty customer who requests a reading of a city meter due to
a contested billing more than twice in the prevmus twelve (12) months, and no error is found

Applicable to any customer who requests the testing of a city meter previously tested within the
past four (4) years and the meter is found to be within accuracy standards

ACCURACY STANDARDS
A meter is defined as wlthm accuracy standards when found to be plus or m~nus two percent
(2%) or less

RETURNED PAYMENT CHARGE
APPLICATION
Apphcable when a customer's or taxpayer's check, or money order, or bank draf~ for payment of
fees, fines, court costs, taxes, utthtxes, or other charges has been dmhonored by the maker's bank
and returned to the City of Denton unpmd
CHARGE
Per Check $25 00
SERVICE DEPOSITS
APPLICATION
Applicable when a residential customer requests utthty service m the C~ty of Denton serwce area
and does not have twelve (12) months of good credit standing w~th the C~ty of Denton or another
utd~ty system for the type of service requested, or does not have a co-s~gner with twelve (12)
months of good credit stanchng w~th the C~ty of Denton, or does not request and demonstrate a
passing credit rating through a credit reporting agency
Applicable when a commercial customer does not have twenty-four (24) months of good credit
standing with the C~ty of Denton, or a commercial letter of good cretht from another utility
system Not applicable when a commercial customer provides an ~rrevocable letter of credit to
the C~ty of Denton as security for payment
CHARGE
Remdentlal Customer $150 00 or an amount equal to 1/6 of the last
12 months of bdhng at the servme loeatmn

Deposits will earn interest for the customer The apphcable rate of ~nterest will be 3 45% and ~s
based on the one-year Umted States Treasury Note as of August 15, 2001 If refund of deposit is

made w~than thirty (30) days of receipt of deposit, no interest payment wdl be made If the Clty
retains the deposit more than thirty (30) days, payment of interest shall be made retroactive to the
date the deposit was pa~d
A Payment of the mterest to the customer shall be made at the t~me the deposit is returned
or credited to the customer's account
B The depomt shall cease to earn ~nterest on the date ~t ~s retumed or credited to the
customer's account
CREDIT REPORT CHARGE
APPLICATION
This fee Is apphcable ~f the customer (a) cannot prowde a satisfactory credit rating through
prewous service tustory w~th Denton Mummpal Uttht~es or another utthty servme, or (b) cannot
prowde the c~ty w~th a quahfied co-s~gner, and (c) prowdes written authonzat~on for the mty to
obtmn a credit rating from a credit source avmlable to the mty

Charge per credit report $12 00
INTEREST EARNED ON CONTRACT RETA1NAGE
Contract retmnage will earn interest for the contractor as promded by TEX REV CIV STAT
ANN Artmle 6252, Sec 5b (Vernon Supp 1992) The rate of interest wall be adjusted sem~-
annually to equal the mterest rate of a one year Umted States Treasury Note on October 1 and
April 1 of each year Payment of the interest shall be made at the t~me the retmnage ~s prod to the
contractor

SECTION 2 That all or&nantes or parts of ordinances in force when the provisions of
this ordinance became effective which are inconsistent, or m conflict w~th the terms or
prows~ons contained in this ordinance are hereby repealed to the extent of any such conflict
SECTION 3 That ff any sectaon, subsectaon, paragraph, sentence, clause, phrase or
word m this ordinance, or apphcat~on thereof to any person or c~rcumstances is held invalid by
any court of competent juns&ct~on, such holding shall not affect the validity of the rem~unlng
portaons of this ordinance, and the C~ty Council of the Caty of Denton, Texas, hereby declares it
would have enacted such remaining portions despite any such ~nval~&ty
SECTION 4 That th~s ordinance shall become effective, charged, and apphed to all
services oceumng on and after October 1, 2001, and a copy of said fees and charges shall be
maanta~ned on file in the office of the C~ty Secretary
