month If the current monthly demand is less than 250 KVA, and 70% of the actual demand
determined during the previous months of May through October is less than either 250 KVA or 225
KW, a mmnnum of 250 KVA demand will be billed for the month In all cases, 250 KVA is the

per KWH, to be known as the energy cost adjustment (ECA) The ECA shall be computed during
the last month of each fiscal year quarter (December, March, June and September) to be apphed to
the quarter immediately following The C~ty shall ~n no case change the energy cost adjustment
more than once m any three (3) month period The ECA shall be calculated usmg the followmg

In the event that actual plus estimated cumulative costs of fuel, variable costs of Texas
Munm~pal Power Agency (TMPA) energy and purchased energy (excludmg TMPA's fixed charges)

next quarter, the D~rector of Electric Utfl~hes or her designate shall recompute the Energy Cost
AdJustment and, w~th Pubhc Utfi~ttes Board approval, may estabhsh an ECA that collects or returns
such d~fference over the next three month penod Such change ~n ECA shall be apphed evenly to
each month dunng the three-month period

(2) CREDIT TO MONTHLY BILL OR MONTHLY RATE
Customer's monthly bill and/or monthly rate shall be in accordance w~th the
apphcable rate schedule(s) ~n effect on July 1, 1997, shall be reduced by 20%
"Base Rates" are defined as the sum of the followmg charges the Facility Charge, the
Demand Charge, the Energy Charge and/or the adjustment for short/extended read
cycles of the apphcable rate schedules Base rates do not tnclude recovery of fuel and
purchased energy costs, mcludmg, wtthout ltrmtatton, energy cost adjustments (the
ECA rate or ~ts successors)
All other charges and calculat~o~s m the rate schedule are unchanged
The rates ~mtxally established on July 1, 1997 by thts Dtscount Pader shall be the
maxnuum or cethng rate charged to the Umverstty of North Texas ("UNT") and
Texas Woman's Umverslty ("TWU") dunng the term of the seven (7) year power
supply agreement If dunng thc term of the power supply agreement any apphcable
tanffed "Base Rates" are reduced by more than 10%, the dtscounted rates for UNT
and TWU wtll be reduced such that the dtscounted "Base Rates" are always at least
10% below any tariffs that w~ll otberwtse be apphcable to the umvers~t~es At no t~me
shall tanffed base rate decrease cause the rate dtscount to the two (2) umvers~t~es to
decrease by mole than 50% over tbe term of the power supply agreement
~ That the Assistant City Manager for Utthtles is hereby authorized to expend
funds to issue rebates to elecmc utility customers in the form and type set forth in Schedules EP and
MTR, as the use of more effiment air con&t~omng compressors, heat pumps, motors, and thermal
storage m m the best interest of the City of Denton, as such will reduce the peak-load and conserve
energy, winch are public purposes of the City
Rg.C~TION ~ That all ordinances or parts of ordinances in rome when the provisions of
tins ordinance became effective which are inconsistent, or m conflict with the terms or provisions
contmned m tins ordinance are hereby repealed to the extent of any such conflict
~qgt. CTION 4. That if any section, subsectton, paragraph, sentence, clause, phrase or word in
tins orchnance, or application thereof to any pet son or c~mumstances ~s held invalid by any court of
competent junsdmtion, such holding shall not affect the vahdlty of the rematmng portions of this

AN ORDINANCE OF THE CITY OF DENTON, TEXAS AMENDING THE SCHEDULE OF
RATES CONTAINED IN ORDINANCE NO 2001-337 FOR ELECTRIC SERVICE,
CANCELLING AND REPEALING THE ENERGYSAVE PROGRAM (SCHEDULE EP)
EFFECTIVE JANUARY 1, 2002, PROVIDING FOR A REPEALER, PROVIDING FOR A
SEVERAB1LITY CLAUSE, AND PROVIDING AN EFFECTIVE DATE
WHEREAS, on November 27, 2001 the City Council approved an ordinance which
amended §28-27 of the Code of Ordinances of the City of Denton, Texas, to provide for the
adoption of the 2000 International Bmldmg Code, the 2000 International Residential Code for
One and Two Family Dwellings, the 2000 International Fuel Gas Code, the 2000 International
Plumbing Code, the 2000 International Meehamcal Code, and the 2000 International Energy
Conservation Code, and
WHEREAS, the City Council deems it in the public interest to cancel and repeal the
EnergySave Program (Schedule EP) and any and all credits or rebates that may be due
thereunder, effective January 1, 2002, because of the provisions of and the passage of the
amended City of Denton Building Code and other Codes, which also become effective on
January 1, 2002, and
WHEREAS, the City staff shall continue to process and to pay any and all applications
for ~nergy credits or rebates under Schedule EP, which are timely received by the City before
January 1, 2002, even ~fthe payment thereof shall occur after January 1, 2002, and
WHEREAS, the City staff intends to immediately study the City of Denton Building
Code and other Codes, as they are now amended, and expects to draft and present to the City
Council a more meamngful and s~gmficant alternative energy credit or rebate program, which it
will offer to the City Council in the near future, NOW THEREFOR
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION 1 That the foregoing preamble to ttus ordinance is incorporated by reference
here~n for all purposes
SECTION 2 That the Schedule of Rates for electrical servmes as provided for in
Chapter 26 of the City of Denton Code of Ordinances, as prowded by Ordinance No 2001-337,
enacted on the 4th day of September, 2001, is hereby amended to cancel and repeal Schedule EP
(EnergySave Program) and any other reference contained in smd Ordinance to the EnergySave
Program or Schedule EP, in its entirety
SECTION 3 That all ordinances or parts of ordinances in force when the prowslons of
this ordinance become effective which are inconsistent, or in conflict with the terms or
provisions contmned in this or&nance are hereby repealed to the extent of any such conflict
SECTION 4 That ~f any sectaon, subsection, paragraph, sentence, clause, phrase, word
~n this orthnance, or apphcat~on thereof to any person or circumstances is held mvahd by any
court of competent jurisdiction, such holding shall not affect the vabthty of the remmmng
portions of ttus ordinance, and the City Council of the C~ty of Denton, Texas, hereby declares ~t
would have enacted such remaining port~ons despite any such lnvahd~ty
SECTION 5 That thru ordinance and the rate hereby canceled and repealed shall
become effective on January 1, 2002, and applied to all electric services rendered by Denton

SECTION 6 That upon its passage and approval, reference shall be made at the top of
the first page of Ordinance No 2001-337, that smd ordinance has been duly amended by th~s
