AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A ZONING
CHANGE FROM AGRICULTURAL (A) ZONING DISTRICT CLASSIFICATION AND USE
DESIGNATION TO COMMERCIAL (C) WITH CONDITIONS ZONING DISTRICT
CLASSIFICATION AND USE DESIGNATION FOR APPROXIMATELY 5 0 ACRES OF LAND
LOCATED BETWEEN MINGO ROAD AND FISH TRAP ROAD, COMMONLY KNOWN AS
5501 FISH TRAP ROAD, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF
$2,000 00 FOR VIOLATIONS THEREOF, PROVDING A SEVERABILITY CLAUSE AND AN
EFFECTIVE DATE (Z01-0032)
WHEREAS, Rodger Donnelly initiated a change ~n zomng for 5 0 acres of land from
Agricultural (A) zoning district classification and use demgnat~on to Commermal (C) with cond~txons
zomng district classification and use designation, and
WHEREAS, on October 10, 2001, the Planmng and Zoning Commission concluded a pubhc
heanng as required by law and recommended approval of the requested change ~n zoning, and
WHEREAS, the C~ty Cotmcfl finds that the change in zoning ~s consistent with the
Comprehensive Plan, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SE~CTION 1 The zoning district classfficat~on and use designation of the approximate 5
acre property described in the legal description attached hereto and incorporated hereto as ExNNt A
is changed from Agricultural (A) zomng district classification and use designation to Commercial
(C) zoning dlsmct classification and use designation under the comprehensive zomng or&nance of
the City of Denton, Texas, subject to the following conditions
1 A 20' wide bufferyard shall be provided along the east and north property hnes, consisting of
one (1) canopy tree for every fifteen (15) linear feet and two (2) understory plants for every
canopy tree, between proposed commercial uses and adjacent exmt~ng remdent~al uses
2 Lighting on the property would be required to be designed and mamtmned so as not to shine
on or otherwise disturb surrotmdlng residential property or to shine and project upward to
prevent the diffusion ~nto the mght sky
3 No outside storage shall be allowed
SECTION 2 The City's Official zoning map 1s amended to show the change m zoning
dlsmct classification

SECTION 3 If any prowsmn of this ordinance or the apphcatmn thereof to any person or
c~rcumstance ~s held lnvahd by any court, such mvahdlty shall not affect the vahdlty of other
prowslons or applications, and to this end the prows~ons of this ordinance are severable
SECTION 4 Any person molat~ng any prowsmn ofth~s ordinance shall, upon conwctmn, be
fined a sum not exceeding $2,000 00 Each day that a provls~on of this ordinance is wolated shall
constitute a separate and distinct offense
SECTION 5 Th~s ordinance shall become effective fourteen (14) days from the date of its
passage, and the City Secretary ~s hereby d~rected to cause the caption of this ordinance to be
published twice m the Denton Record-Chromcle, a dady newspaper pubhshed ~n the C~ty of Denton,
Texas, within ten (10) days of the date of its passage
