AN ORDINANCE OF THE CITY OF DENTON, TEXAS PROVIDING FOR APPROVAL OF
A ZONING PLAN PERMITTING SINGLE-FAMILY RESIDENTIAL DEVELOPMENT FOR
APPROXIMATELY 47 412 ACRES OF LAND GENERALLY LOCATED EAST OF US
HIGHWAY 377 (FORT WORTH DRIVE) AND SOUTH OF BRUSH CREEK ROAD AND
LEGALLY DESCRIBED AS 47412 ACRES IN THE G DAUGHERTY SURVEY,
ABSTRACT NO 351, THE H HAGGOOD SURVEY, ABSTRACT NO 517, AND THE W
HUDSON SURVEY, ABSTRACT NO 586, IN THE CITY OF DENTON, DENTON
COUNTY, TEXAS, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF
$2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE

WHEREAS, on March 2, 2000, the City Council adopted Ordinance No 2000-046 wluch
estabhshed certmn residential interim regulations (the "Residential Interim Regulations"),
WHEREAS, the Residential Interim Regulations established, among other thmgs, a
Zoning Plan requirement in the event of a request to develop certmn residential subdivisions, and
WHEREAS, Carmen Investments, Inc has submitted a Zoning Plan under the Residential
Interim Regulations, a copy of which is attached hereto as Exhibit "B", for 47 412 acres of land
generally located east of US Highway 377 (Fort Worth Drive) and south of Brash Creek Road
and currently zoned One-Family Dwelling (SF-16), with the intent to develop a single-family
residential, and
WHEREAS, on October 10, 2001, the Planning and Zoning Commission recommended
approval of a Zomng Plan for such 47 412 acres, and
WHEREAS, the City Council finds that the Zoning Plan, with the conditions imposed
herein, if any, meets the requirements of the Residential Interim Regulations and the
Nonresidential Interim Regulations and is consistent with the approved 1999-2020 Denton
Comprehensive Plan, NOW, THEREFORE,
THE COLrNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION 1 A Zoning Plan for the 47 412 acre property described in the legal
descl tpt~on attached hereto and incorporated herein as Exhibit "A" is adopted allowing single-
family uses as provided in said Zomng Plan being attached hereto and incorporated herem as
Exhibit "B' for all purposes, subject to the following condition
No lots or buildings shall be in the floodplain as ultimately defined by the Federal
Emergency Management Agency ("FEMA") The 100-year floodplmn as described by
Goodwln and Marshall Inc flood study is subject to review and approval by City of
Denton and subsequent issuance of a Letter of Map Revision by FEMA Any changes to
the floodplain through this process could alter the open space/floodplmn and the
bmldable area as shown on the zoning plan
SECTION 2 The City's official zoning map is amended to show the change in zomng
district classification
SECTION 3 Any person violating any provlslon of this ordinance shall, upon
conwctmn, be fined a sum not exceeding $2,000 00 Each day that a provision of this ordinance
is violated shall constitute a separate and distinct offense
SECT1ON 4 This ordinance shall become effective fourteen (14) days from the date of
its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be
pubhshed twice in the Denton Record Chronicle, official newspaper of the City of Denton,
Texas, within ten (10) days of the date of its passage
