AN ORDINANCE OF THE CITY OF DENTON, TEXAS AMENDING THE SCHEDULE OF
RATES CONTAINED IN ORDINANCE NO 2001-337 FOR ELECTRIC SERVICE,
CANCELLING AND REPEALING THE ENERGYSAVE PROGRAM (SCHEDULE EP)
EFFECTIVE JANUARY 1, 2002, PROVIDING FOR A REPEALER, PROVIDING FOR A
SEVERABILITY CLAUSE, AND PROVIDING AN EFFECTIVE DATE
WHEREAS, on November 27, 2001 the City Council approved an ordinance which
amended §28-2? of the Code of Ordinances of the City of Denton, Texas, to prowde for the
adoption of the 2000 International Bml~hng Code, the ?~000 International Residential Code for
One and Two Family Dvcellmgs, the 2000 International Fuel Gas Code, the 2000 International
Plumbmg Code, the 2000 International Mechanical Code, and the 2000 International Energy
Conservation Code, and
WHEREAS, the C~ty Council deems ~t m the pubhc mterest to cancel and repeal the
EnergySave Program (Schedule EP) and any and all credits or rebates that may be due
thereunder, effective 1anuary 1, 2002, because of the prows~ons of and the passage of the
amended C~ty of Denton Building Code and other Codes, which also become effectwe on
January 1, 2002, and
WHEREAS, the C~ty staff shall continue to process and to pay any and all applications
for energy credits or rebates under Schedule EP, which are t~mely received by the City before
January 1, 2002, even if the payment thereof shall occur after January l, 2002, and
WHEREAS, the C~ty staff intends to immediately study the C~ty of Denton Building
Code and other Codes, as they are now amended, and expects to draf~ and present to the C~ty
Council a more meamngful and sigmficant alternative energy credit or rebate program, which it
will offer,to the C~ty Council m the near future, NOW THEREFOR
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION 1 That the foregoing preamble to this ordmance is incorporated by reference
hereto for all purposes
S~CTION 2 That the Schedule of Rates for electrical services as provided for in
Chapter 26 of the City of Denton Code of Ordinances, as prowded by Ordinance No 2001-3~?,
enacted on the 4th day of September, 2001, ~s hereby amended to cancel and repeal Schedule EP
(EnergySave Program) and any other reference contamed m sa~d Ordinance to the EnergySave
Program or Schedule EP, m its entirety
SECTION 3 That all ordinances or parts of ordinances m force when the prows~ons of
this or(h~ance become effectwe wl~ch are mconslstent, or m conflict w~th the terms or
provisions contained m th~s or(hnance are hereby repealed to the extent of any such conflict
SECTION 4 That if any section, subsection, paragraph, sentence, clause, phrase, word
xn this ordinance, or application thereof to any person or c~rcumstances is held invalid by any
court of competent junsdxction, such holding shall not affect the validity of the remaining
portions of this ordinance, and the City Council of the City of Denton, Texas, hereby declares it
would have enacted such remaining portions despite any such lnvahdlty
SECTION 5 That fins ordinance and the rate hereby canceled and repealed shall
become effective on January 1, 2002, and applied to all electric services rendered by Denton
Municipal Electric A copy of smd ordinance shall be mmntained on file m the Office of the C~ty
Secretary
SECTION 6 That upon ItS passage and approval, reference shall be made at the top of
the first page of Ordinance No 2001-337, that smd ordinance has been duly amended by this
ordinance, effective January 1, 2002
