AN ORDINANCE OF THE CITY OF DENTON, TEXAS, AUTHORIZING A JOINT PUBLIC
HEARING WITH THE PLANNING AND ZONING COMMISSION AND THE CITY
COUNCIL TO BE HELD ON FEBRUARY 8, 2000 PURSUANT TO TEXAS LOCAL
GOVERNMENT CODE §211 007 (b) AT THE CITY COUNCIL CHAMBERS AT 6
O'CLOCK PM TO CONSIDER RECOMMENDATION AND ACTION UPON AN
ORDINANCE CREATING NONRESIDENTIAL INTERIM REGULATIONS FOR THE
IMPLEMENTATION OF THE NEW COMPREHENSIVE PLAN OF THE CITY OF
DENTON, PRESCRIBING NOTICE OF THE JOINT MEETING PURSUANT TO TEXAS
LOCAL GOVERNMENT CODE §211 007 (d), PROVIDING FOR A RECOMMENDATION
BY THE PLANNING AND ZONING COMMISSION, SUPERCEDING THE PROVISIONS
OF ALL ORDINANCES ON THE SAME SUBJECT MATTER TO THE EXTENT OF A
CONFLICT, AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, the Denton City Council pursuant to ~ts home rule powers and Section 219
of the Texas Local Government Code, has adopted a new Comprehensive Plan, and
WHEREAS, the C~ty Council has previously appointed a City of Denton Code
Committee to undergo the process of recommending new development regulations that are
consistent with the policies set forth in the new Comprehensxve Plan, and
WHEREAS, m order to implement some of the pohmes pertmnmg to nonresidential uses
contained w~thxn the new Comprehensive Plan, on an ~ntenm bas~s pending the adoption of new
development regulations, the C~ty Council deems it prudent to consider the adoption of interim
regulations, and
WHEREAS, pursuant to Texas Local Government Code §211 007, the Caty Council
desires to have a joint public heanng with the Planmng and Zomng Commission on February 1,
2000 at the City Cotmcll Chambers at 6 o'clock p m, regarding the interim regulations, and
WHEREAS, pursuant to Texas Local Government Code §211 007 (d), the City Council
wishes to prescribe not,ce of the time and place of the joint public heanng in a manner that is
efficient and economical, and
WHEREAS, by a two-thirds vote of the City Council, as required by Texas Local
Government Code §211 007 (d) the prescribed notice of the jmnt public heanng shall be as
hereinafter set forth within tins or&nance, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON, TEXAS HEREBY ORDAINS
~ That the Denton City Council and the C~ty of Denton Planning and Zomng
Commmslon shall conduct a joint pubhc heanng pursuant to Texas Local Government Code
§211 007 (b) on February 8, 2000 at the City Council Chambers located in City Hall at 215 East
McKlnney Street ~n Denton, Texas, at 6 o'clock p m to receive pubhc ~nput, consider, make
recommeodat~on, and/or take appropriate action concermng a proposed ordinance adopting
nonresadeimal interim regulations ~mplementlng policies contmned w~thln the new
Comprehensive Plan
SECTION 2 That the notice of the tame and place for the joint pubhc heanng on
February 8, 2000 shall be g~ven on two separate occasions as follows
a Before the 15th day before the public hearing, a notice of the date, tame and place
of the pubhc heanng shall be pubhshed an the Denton Record-Chromcle m two
separate places, the legal notice section and another location in the newspaper
separate from the legal notme section, and
b Before the 7th day before the pubhc heanng, a notice of the date, t~me and place of
the pubhc heanng shall be pubhshed in the Denton Record-Chromcle m two
separate places, the legal notice section and another location m the newspaper
separate from the legal not,ce section
SECTION 3 The notice prowded for herein as anthonzed by Subsectxon 211 007(d) of
the Local, Government Code Th~s orchnance and the notme reqmrements conttuned w~thxn this
orchnance supercede any other not,ce reqmrements set forth in state law and other C~ty of Danton
ordxnances mcludmg w~thout hmxtat~on the notice requirements set forth m Subsections
211 006(a) and 211 007(b) and (c) of the Local Government Code and Sectmn 35-7 of the Code
of Ordinances of the Cxty of Denton
SECTION 4 The Plamng and Zomng Commission may make ~ts recommendatxon to the
City Council concerning the proposed nonresidential interim regulations at the same joint pubhc
heanng meeting or may defer as recommendation to a later Plannmg and Zomng Commission
meetmg If the recommendation xs deferred to a later Plarunng and Zoning Commission meeting
such recommendatmn may be referred to the City Council at any special or regular City Council
meeting regardless of the txme between such Planning and Zoning Commm~on meeting and City
Council rheetlng
~ Thxs ordinance supercedes the provisions of any other ordxnance on the
same subject matter to the extent of a eonfl~ct
SECTION 6 The findings contained xn the preamble of this ordinance are incorporated
hereto as ff fully set forth wxthm the body of this ordinance
