2000-048AN ORDINANCE OF THE CITY OF DENTON, TEXAS, ANNEXING 23 89 ACRES OF LAND CONTIGUOUS AND ADJACENT TO THE CITY OF DENTON, TEXAS, LOCATED AT THE SOUTHWEST CORNER OF SILVER DOME AND COOPER CREEK IN THE COUNTY OF DENTON, TEXAS, APPROVING A SERVICE PLAN FOR THE ANNEXED PROPERTY, PROVIDING A SEVERABILITY CLAUSE, AND PROVIDING AN EFFECTIVE DATE (A-96) WHEREAS, Wynne/Jackson, Inc, on behalf of Dr Edward F Wolskl, has petitioned for the annexation of 23 89 acres of land described here~n, and WHEREAS, on December 15, 1999 the Planning and Zoning Commlsslon recommended approval of the petition for annexation, and WHEREAS, public heanngs were held In the Council Chambers on November 2, 1999, and November 16, 1999, (both days being on or after the 40th day but before the 20th day before the date of the mst~tutlon of the pmcee&ngs) to allow all ~nterested persons to state their views and present evidence bearing upon tlus annexation, and WHEREAS, annexation proceerhngs were ~nstltuted for the property described here~n by the introduction of this ordinance at a meeting of the City Cotmml on December 7, 1999, and WHEREAS, th~s ordinance has been published m full one time in the official newspaper of the City of Denton on December 19, 1999, after annexation proceedings were ~nstltUted and 30 days prior to City Cotmml taking final action, as reqmred by C~ty Charter, and WHEREAS, the City Councd finds that the annexation wall be ~n compliance w~th the 1988 Denton Development Plan, the 1998 Denton Plan Pohmes, and the 1999 Growth Management Strategies and Plan, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDA1NS SECTION 1 That the tract of land described m Exhibit "A", attached hereto and ~ncorporated by reference, ~s annexed to the C~ty of Denton, Texas SECTION 2 That the service plan attached as Exhibit "B", and mcorporated by reference, whmh provides for the extension of mumc~pal services to the annexed property, is approved as part of thru ordinance SECTION 3 Should any part of thru ordinance be held illegal for any reason, the holding shall not affect the remmmng portion of this ordinance and the C~ty Council hereby declares it to be ~ts purpose to annex to the C~ty of Denton all the real property described in Exhibit "A" regardless of whether any other part of the described property ~s hereby effectively annexed to the City If any part of the real property annexed is already included within the city limits of the C~ty of Denton or within the hm~ts of any other city, town or village, or ~s not within the C~ty of Demon's jurisdiction to annex, the same is hereby excluded from the temtory annexed as fully as ~f the excluded area were expressly described ~n this orchnance SECTION 4 That this ordinance shall become effective ~mmechately upon its passage and approval PASSED AND APPROVED this the /~ day of~~~, 2000 JAC~II~LER, MAYOR ATTEST JENNIFER WALTERS, CITY SECRETARY APPROVED AS TO LEGAL FORM HERBERT L PROUTY, CITY ATTORNEY Page 2 of 2 EXHIBIT A WILUAM V.
