AN ORDINANCE ACCEPTING COMPETITIVE BIDS AND AWARDING A CONTRACT FOR
THE PURCHASE OF MEDIUM & HEAVY TRUCKS, PROVIDING FOR THE EXPENDITURE
OF FUNDS THEREFOR, AND PROVIDING AN EFFECTIVE DATE (BID 2456 - MEDIUM
AND HEAVY TRUCKS AWARDED TO PETERBILT MOTOR CO, IN THE AMOUNT OF
$139,802)
WHEREAS, the C~ty has sohc~ted, received and tabulated compeut~ve Nds for the purchase
of necessary materials, eqmpment, supphes or servmes xn accordance wxth the procedures of STATE
law and City ordinances, and
WHEREAS, Section 271 905 of the Local Government Code allows the C~ty to award a
contract to a Ndder hawng ~ts pnnmpal place of business xn the C~ty xf~ts bid ~s vatlun three per cent
of the lowest bid price recexved from a nonresxdant bidder ~f the govermng body determines xn
writing, that the local Ndder offers the C~ty the best comNnat~on of price and additional economic
development opportumttes for the C~ty created by the contract award, ~ncludmg the employment of
remdents of the C~ty and xncreased tax revenues to the Cxty, and
WHEREAS, the C~ty Manager or a designated employee has rewewed the herren described
Nds for the materials, eqmpment, supplies or services as shown xn the "Bxd Proposals" submxtted
therefore and represents to the Cxty Cotmcfl that the herren described local Ndder's Nd ~s wxthxn
three per cent of lowest Nd price recexved from a nonresident Ndder, and
WHEREAS, the C~ty Councd has prowded ~n the C~ty Budget for the appmprmtton of funds
to be used for the purchase of the materials, eqmpment, supphes or servmes approved and accepted
herexn, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION 1 The Cxty Council hereby determxnes that the vendor set forth below has xts
pnnmpal place of business ~n the C~ty of Denton, Texas, as Nd ~s wltNn three per cent of the lowest
Nd price recmved from a noures~dent Ndder and such local Ndder offers the C~ty the best
combination of price and addltaonal economic development oppomm~taes for the City created by th~s
contract award The numbered 1terns ~n the following numbered bids for materials, eqmpment,
supphes, or services from the below described local Ndder and as shown ~n the "Bid Proposals" on
file ~n the office of the C~ty Purchasing Agent, are hereby accepted and approved

SECTION 2 By the acceptance and approval of the above numbered items of the submitted

chase the materials, equipment, supphes or services in accordance with the terms, specifications,
standards, quanUtles and for the specified sums contained m the Bid Invitations, Bxd Proposals, and
related documents
SECTION 3 Should the City and persons submmlng approved and accepted items and of
the submitted bids wish to enter ~nto a formal written agreement as a result of the acceptance,
approval, and awarding of the bids, the City Manager or his designated representative is hereby
authorized to execute the written contract wtuch shall be attached hereto, provided that the written
contract ~s m accordance with the terms, condmons, spec~ficaUons, standards, quantities and
specified sums contamed m the Bid Proposal and related documents herexn approved and accepted
SECTION 4 By the acceptance and approval of the above numbered ~tems of the submxtted
bids, the City Council hereby authorizes the expenditure of funds therefor m the amount and xn
accordance vath the approved bids or pursuant to a written contract made pursuant thereto as
authorized herein
SECTION 5 Thxs ordinance shall become effective immediately upon its passage and
approval
