COMMISSION AND THE CITY COUNCIL TO BE HELD ON THURSDAY, MARCH 2,
2000 PURSUANT TO TEXAS LOCAL GOVERNMENT CODE §211 007 (b) AT THE CITY
COUNCIL CHAMBERS AT 6 O'CLOCK P M TO CONSIDER RECOMMENDATION AND
ACTION UPON AN ORDINANCE CREATING NONRESIDENTIAL INTERIM
REGULATIONS FOR THE IMPLEMENTATION OF THE NEW COMPREHENSIVE PLAN
OF THE CITY OF DENTON, PRESCRIBING NOTICE OF THE JOINT MEETING
PURSUANT TO TEXAS LOCAL GOVERNMENT CODE §211 007 (d), PROVIDING FOR A
RECOMMENDATION BY THE PLANNING AND ZONING COMMISSION,
SUPERCEDING THE PROVISIONS OF ALL ORDINANCES ON THE SAME SUBJECT
MATTER TO THE EXTENT OF A CONFLICT, AND PROVIDING FOR AN EFFECTIVE
DATE
WI-IEREAS, the Denton City Council pursuant to 1ts home rule powers and Section 219
of the Texas Local Government Code, has adopted a new Comprehensive Plan, and
WHEREAS, the City Council has prev,ously appointed a City of Denton Code
Committee to undergo the process of recommending new development regulations that are
consistent with the policies set forth in the new Comprehensive Plan, and
WHEREAS, m order to implement some of the policies pertaining to nonresidential uses
contmned within the new Comprehensive Plan, on an interim basis penchng the adoption of new
development regulations, the City Council deems ~t prudent to consider the adoption of interim
regulations, and
WHEREAS, pursuant to Texas Local Government Code §211 007, the City Council
desires to have a joint public hearing with the Plaunmg and Zoning Commission on March 2,
2000 at the City Council Chambers at 6 o'clock p m, regarding the interim regulations, and
WHEREAS, pursuant to Texas Local Government Code §211 007 (d), the City Council
washes to prescribe notme of the time and place of the joint public heanng m a manner that is
efficient and economical, and
WHEREAS, by a two-thirds vote of the City Council, as required by Texas Local
Government Code §211 007 (d) the prescribed notice of the joint public heanng shall be as
hereinafter set forth within this ordinance, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON, TEXAS HEREBY ORDAINS
S~ECTION 1 That the Denton City Council and the City of Denton Planning and Zoning
Commission shall conduct a specml called joint public heanng pursuant to Texas Local
Government Code {}211 007 (b) on Thursday, March 2, 2000 at the City Council Chambers
located in City Hall at 215 East MclQnney Street in Denton, Texas, at 6 o'clock p m to receive
public Input, consider, make recommendation, and/or take appropnate action concerning a
proposed ordmance adopting nonresidential interim regulations implementing policies contmned
within the new Comprehensive Plan
~ That the notice of the time and place for the jmnt public heanng on March
2, 2000 shall be given on two separate occasions as follows
a Before the 15th day before the public heanng, a notice of the date, time and place
of the public heanng shall be published in the Denton Record-Chromcle in two
separate places, the legal notice section and another location in the newspaper
separate from the legal notice section, and
b Before the 7th day before the public heanng, a notice of the date, time and place of
the public heanng shall be pubhshed in the Denton Record-Chronicle an two
separate places, the legal notice section and another location in the newspaper
separate from the legal notice section
~ The noUce provided for herein is anthonzed by Subsectmn 211 007(d) of
the Local Government Code This orrhnance and the notice requirements contained within this
orrhnanee supereede any other notme requirements set forth in state law and other C~ty of Denton
ordinances meluchng without limitation the notice requirements set forth in Subsections
211 006(a) and 211 007(b) and (c) of the Local Government Code and Section 35-7 of the Code
of Ordinances of the City of Denton
SECTION 4 The Planing and Zoning Commission may make its recommendation to the
City Council concerning the proposed nonresidential interim regulations at the same joint public
heanng meeting or may defer its recommendation to a later Planning and Zomng Commission
meetmg If the recommendation is deferred to a later Planning and Zoning Commission meetmg
such recommendation may be referred to the City Council at any special or regular City Cotmml
meeting regardless of the time between such Planning and Zomng Commission meeting and City
Council meetmg
SECTION 5 This ordinance supercedes the provisions of any other ordinance on the
same subject matter to the extent of a conflict

herein as ff fully set forth within the body of this ordinance
SECTION 7 This ordinance shall become effective immediately upon its passage and
approval
