2000-067 NO OOD AN ORDINANCE ORDERING AN ELECTION TO BE HELD IN THE CITY OF DENTON, TEXAS, ON MAY 6, 2000, AND, IF A RUNOFF ELECTION IS REQUIRED, ON JUNE 3, 2000, FOR THE PURPOSE OF ELECTING COUNCILMEMBERS TO PLACES 5 AND 6 AND ELECTING A MAYOR TO PLACE 7 OF THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS, DESIGNATING VOTING PLACES, APPOINTING ELECTION OFFICIALS, PROVIDING FOR EARLY VOTING, PROVIDING FOR BILINGUAL NOTICE OF THE ELECTION, ORDERING THAT AN ELECTRONIC VOTING SYSTEM BE USED, AND PROVIDING FOR AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION 1 That a mumc~pal electxon ~s ordered to be held m the City of Denton, Texas, on Saturday, May 6, 2000, such date being a uniform elect~on date as defined in Tex Elec Code §41 001, as mended (the "Code"), for the purpose of electing Councflmembers for Places 5 and 6 and eleetang a Mayor to Place 7 In the event a runoff ~s required, the nmoff elecUon shall be held on Saturday, June 3, 2000 SECTION 2 That the polhng places, which shall be open from 7 00 a m to 7 00 p m, shall be as follows Voters residing ~n Dlsmct No 1 shall vote at MARTIN LUTHER KING, JR RECREATION CENTER 1300 WILSON STREET DENTON, TEXAS 2 Voters residing an District No 2 shall vote at FIRE STATION NO 4 2110 SHERMAN DRIVE DENTON, TEXAS 3 Voters residing m D~stnet No 3 shall vote at NORTH LAKES RECREATION CENTER 2001 WEST WINDSOR DRIVE DENTON, TEXAS 4 Voters res~chng ~n D~stnet No 4 shall vote at DENIA PARK RECREATION CENTER 1001 PARVIN DENTON, TEXAS SECTION 3 That the election officials for the electron and the runoff, ~f any, shall be as follows 1 For the Central Counting Station George Spuller, Presiding Judge, Don Alexander, Manager, and Ran(he Smath, Tabulation Supervisor 2 For Dlsmct No 1 Ruby Cole, Presiding Judge and Alma Clark, Alternate Judge 3 For Dmtnct No 2 Dons Chapman, Presiding Judge and Mary Mecay, Alternate Judge 4 For Dmmct No 3 Bill Wfihamson, Pres~dmg Judge and Kathy B~ggs, Alternate Judge 5 For D~smet No 4 J~mnne Colwlle, Presiding Judge and Ahce Waddell, Alternate Judge 6 Jenmfer Walters, City Secretary, shall conduct early voting under the Texas Elect~on Code 7 George Spuller shall be Presiding Judge for the Early Ballot Board The presxchng judge of the Central Counting Station and of each d~smct are authorized to appoint ~ sufficient number of clerks as necessary to assmt them in the election, including bflmgual assistants as reqmred by law The rate of pay for elect~on judges and clerks shall be the maxnnum mount provided for by State law SECTION 4 That early voting shall be conducted for the election, and the runoffelectlon ~f necessary, by the Office of the City Secretary m the Mumc~pal Bmld~ng at 215 East McKumey Street m the City of Denton, Texas The polls for early voting by personal appearance shall be open between ~he hours of 8 00 a m and 5 00 p m Monday through Friday, commencing April 19, 2000, and ending on May 2, 2000 In addition, early voting shall be held on Saturday, April 22, 2000, between the hours of 10 00 a m and 3 00 p m, at the same location as weekday early voting SECTION 5 That the Mayor ~s hereby d~rected to provide not~ce of the election, and the runoff election if necessary, m accordance w~th Sections 4 002 and 4 003 of Texas Election Code and as reqmred by other applicable prowslons of the law, the not,ce to be pnnted ~n the Spamsh languagel and the English language SECTION 6 That an electrome voting system using optically scanned ballots, meeting the reqmrements of Chapter 124 of the Code, shall be used for smd elect~on Preparation of the necessary equipment and offimal ballots for the election shall conform to the reqmrements of the Code SECTION 7 That C~ty Secretary is authorized to prepare the official ballot for the elect~on and perfOrm every act reqmred by the City Charter and laws of the State of Texas for hokhng electlons~ SECTION 8 The elect~on officers named above shall make retums for the elect~on ~n the manner ~eqmred by law The ballots that are properly marked ~n conformance w~th the provtsmns of the Texas Election Code for votes cast both dunng the period of early voting and on the date of the electron shall be counted m the manner required by law SECTION 9 That the manner of holding such election and all questions pertmmng thereto shall be g0vemed by the elect~on laws of the State of Texas SECTION 10 Substanttal copies oftlus ordinance m both English and Spamsh shall serve as proper notme of the election and stud notate shall be (a) published at least once m a newspaper of general mrculat~on published wltlun the City, not less than the thirtieth day or later than the tenth day before the elect~on, (b) posted, not later than the twenty-first day before the elact~on day, at a public place m each elactmn chstnct that is m the junsdmtlon of the city, (c) posted, not later than the twenty-first day before elect~on day a copy of the notice, wtuch must ~nclude the location of each polling place, on the bulletin board used for posting notmes of meetings of the City Council of the City, and (d) posted, as may otherwise be required by Tex Elec Code §4 003 and other apphcable law SECTION 11 That the City Council has found and determined that the meeting at which this ordinance is considered ~s open to the public and that notice thereof was given in accordance with provisions of the Texas open meetings law, Tex Gov't Code ch 551, as amended, and that a quorum of the City Council was present SECTION 12 That flus ordinance shall become effective
