2000-092 ORDINANCE NO AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A DETAILED PLAN FOR 18 4 ACRES LOCATED WITHIN PLANNED DEVELOPMENT 111 (PD-111) ZONING DISTRICT, THE SUBJECT PROPERTY BEING THE PROPERTY GENERALLY LOCATED EAST OF NOWLIN ROAD AND SOUTH OF ROBINSON ROAD, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, PROVIDING A SEVERABILITY CLAUSE AND AN EFFECTIVE DATE (Z-99-103) WHEREAS, on March 2, 1999, the Caty Council approved a Amended Concept Plan for the Planned Development 111 (PD-11 l) contaimng 131 76 acres, and WHEREAS, Carter and Burgess, Inc, on behalf of Pulte Homes of Texas L P, has apphed for a approval of a detailed plan for 18 4 acres located w~thln Planned Development 111 (PD-111), and WHEREAS, on February 9, 2000, the Planmng and Zomng Commmmon recommended approval of the Detmled Plan w~th eondlt~ons, and WHEREAS, the C~ty Council finds that the Detailed Plan for 18 4 acres located w~than Planned Development 111 (PD-111) m consmtent wath the concept plan, NOW, THEREFORE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS .~ The Detailed Plan attached hereto and aneorporated here~n by reference as Exh~bat "A" for 18 4 acres located w~thm PD-111, and more particularly described an Exh~bat "B", whaeh as attached hereto and ~ncorporated hereto by reference, is hereby approved, subject to the followm§ eon&nons 1 A,site plan shall be submitted to, rewewed and approved by DRC, for the following lots prior to the issuing ofbufldang penmts Block 2, Lot 54, Block 3, Lots 7, and 14, Block 5, Lots 2 and 10, Block 6, Lots 3, and 10, Block 7, Lots 6, and 1 l, Block 8, Lot 6, Block 9, Lots 38, and 50, as more particularly shown on Exh~bat "C" attached hereto and incorporated hereto by reference 2 The masonry reqmrement set forth on the Detailed Plan as amended to read as follows All dwelhng umts shall be constructed of masonry (brick or stone), stucco, or of a glass building material of the kind usually used for outrode wall eonstructaon, to the extent of at least eighty (80%) percent of the area of the outsade walls .~ If any prowmon oftlus ordinance or the apphcat~on thereof to any person or eareumstanee as held mvalad by any court, such ~nvahdlty shall not affect the val~&ty of other provlmons or apphcanons, and to flus end the provamons of th~s or&nance are severable ~ That any person violating any pmwslon of th~s ordinance shall, upon convactlon,'be freed a sum not exceeding $2,000 00 Each day that a provmon of this ordinance is violated shall constitute a separate and thstmct offense ~u~LT.
