AN ORDiNANCE OF THE CITY OF DENTON, TEXAS, PARTIALLY ABANDONING AND
VACATING A 70 FOOT UTILITY EASEMENT ON BLOCK 8 & 9, WIMBLETON
VILLAGE, PHASE III, BLOCK 10 WlMBLETON VILLAGE, PHASE V, AND LOT 1,
BLOCK A, JAMES WOOD AUTOPARK ADDITION AND RECORDED IN VOLUME 1029,
PAGE 480 OF THE DEED RECORDS OF DENTON COUNTY, TEXAS, AND
DECLARING AN EFFECTIVE DATE
WHEREAS, the C~ty of Denton has received a request for a part~al abandonment of a 70
Foot utlhty easement, and
WHEREAS, the Planmng and Zomng Commission of the Cay of Denton, Texas,
reviewed the requested abandonment and recommended approval, and
WHEREAS, the C~ty Cotmcd of the C~ty of Denton has determined that the porhon of the
ut~hty Easement being vacated ~s no longer needed for pubhc use based on new easements whmh
were granted by the property owners, and
WHEREAS, the process for determ~mng fmr market value of the port~on of the Utd~ty
Easement being vacated, as apphcable, pursuant to TEX LOC GOV'T CODE §272 001 shall be
followed ~n effectuating th~s abandonment, NOW, THEREFORE,
THE COUNCIL OF THE CITY DENTON HEREBY ORDAINS
SECTION 1 That the port~on of the Utility Easement recorded m Volume 1029, Page
480 of the Deed Records of Denton County, Texas and more partmularly described as the 70
Foot Utility Easement on Block 8 & 9, Wtmbleton Vdlage, Phase III, Block 10, W~mbleton
V~llage, Phase V, and Lot 1, Block A, James Wood Autopark Ad&tlon, as legally described in
Exhibit "A" and shown ~n Exhibit "B" which are attached hereto and ~ncorporated hereto by
reference, ~s vacated and permanently abandoned as a public easement, to the extent described in
Exhibit "A" and Exhibit "B"
~ That the ~nterests of the City of Denton in the easement above described is
hereby released and will revert to the owners as prowded by law
SECTION 3 That th~s ordinance shall become effective ~mmedmtely upon ~ts passage
and approval
