AN ORDINANCE ACCEPTING COMPETITIVE BIDS AND AWARDING A CONTRACT FOR
THE PURCHASE OF THREE HYDRAULIC DIGGER DERRICK TRUCKS, PROVIDING FOR
THE EXPENDITURE OF FUNDS THEREFOR, AND PROVIDING AN EFFECTIVE DATE (BID
2469 - DIGGER DERRICK TRUCKS AWARDED TO PETERBILT MOTORS CO/DALLAS
PETERBILT INC IN THE TOTAL AMOUNT OF $409,799 INCLUDING $74,000 FOR TRADE-
IN OF TWO OLDER UNITS)
WHEREAS, the City has solicited, received and tabulated competmve b~ds for the purchase
of necessary materials, eqmpment, supplies or services in accordance w~th the procedures of STATE
law and City ordinances, and
WHEREAS, the City Manager or a designated employee has reviewed and recommended
that the hereto described bids are the lowest responmble bids for the materials, equipment, supplies
or services as shown In the "Bxd Proposals" submitted therefore, and
WHEREAS, the City Council has pmwded ~n the C~ty Budget for the appropriation of funds
to be used for the purchase of the materials, eqmpment, supphes or services approved and accepted
hereto, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That the numbered items in the following numbered b~ds for matenals,
equipment, supphes, or services, shown in the "B~d Proposals" on file m the office of the City
Purchasing Agent, are hereby accepted and approved as being the lowest responsible bids for such
items

S~CTION II That by the acceptance and approval of the above numbered items of the
submitted bads, the C~ty accepts the offer of the persons submitting the b~ds for such ~tems and
agrees to purchase the materials, eqmpment, supphes or services an accordance with the terms,
specifications, standards, quantmes and for the specified sums eontmned ~n the Bid Invitations, Bid
Proposals, and related documents
SECTION III That should the C~ty and persons submitting approved and accepted items
and of the submitted b~ds w~sh to enter Into a formal written agreement as a result of the acceptance,
approval, and awarding of the b~ds, the C~ty Manager or his designated representative as hereby
authorized to execute the written contract wluch shall be attached hereto, provided that the written
contract is in accordance w~th the terms, conditions, specifications, standards, quantities and
specified sums eontmned an the B~d Proposal and related documents herein approved and accepted
SECTION IV That by the acceptance and approval of the above numbered ~tems of the
submitted,bads, the C~ty Cotmcd hereby authorizes the expendaure of funds therefor ~n the amount
and m accordance w~th the approved bads or pursuant to a written contract made pursuant thereto as
authorized hereto
SECTION V That th~s ordinance shall become effective ~mmed~ately upon ~ts passage and
approval
