AN ORDINANCE ACCEPTING COMPETITIVE BIDS AND AWARDING AS ANNUAL
CONTRACT FOR THE PURCHASE OF MATERIALS, SUPPLIES OR SERVICES, PROVIDING
FOR THE EXPENDITURE OF FUNDS THEREFOR, AND PROVIDING AN EFFECTIVE DATE
(BID 2479 - WOOD GRINDING FOR COMPOST OPERATION AWARDED TO THELIN
RECYCLING CO, IN THE ESTIMATED AMOUNT OF $93,000)
WHEREAS, the City on January 20, 2000 sohclted, received and tabulated competitive buls
for the purchase of necessary materials, eqmpment, supphes or servmes m accordance w~th the
procedures of STATE law and City ordmanees (the "Pnor B~d Procedures"), and
WHEREAS, bids were received and opened on January, 25, 2000 for the Prior Btd
Procedures, and
WHEREAS, after the opemng of the b~ds it became apparent that a bid specfficat~m
requmng 8000 cubic yards per load d~d not accurately reflect the Ctty's practice of 20,000 cubic
yards per load, and
WHEREAS, due to flus rhseovery a decision was made to reject all bads and re-advertise (the
B~ds Rejectmn"), and
WHEREAS, the C~ty has re-advertised, sohc~ted, received and tabulated competitive bids
for the purchase of necessary materials, equipment, supphes or services ~n accordance w~th the
procedures of STATE law and City ordxnances, and
WHEREAS, the City Manager or a designated employee has reviewed and recommended
that the hereto described bads are the lowest responsable bads for the materials, equipment, supphes
or servmes as shown m the "Btd Proposals" submitted therefore, and
WHEREAS, the City Cotmcfl has pmwded in the City Budget for the appropnatlon of funds
to be used for the purchase of the materials, eqmpment, supplies or services approved and accepied
here~n, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION 1 The C~ty Council hereby ratifies and approves the Bids RejecUon for the Pnor
B~d Procedure
~ The numbered items m the followmg numbered b~ds for materials, eqmpment,
supphes, or servmes, shown in the "B~d Proposals" on file m the office of the City Purchasing Agent,
are hereby accepted and approved as being the lowest responsible bids for such items

SECTION 3 By the acceptance and approval of the above numbered items of the submitted
bxds, the City accepts the offer of the persons submitting the bads for such xtems and agrees to pur-
chase the materials, eqmpment, supphes or servmes m accordance with the terms, specfficattons,
standards, quantattes and for the spccffied sums contmned m the Bad Invitations, B~d Proposals, and
related documents
~ Should the City and persons submitting approved and accepted items and of
the submitted b~ds wash to enter mto a formal written agreement as a result of the acceptance,
approval, and awardmg of the bads, the C~ty Manager or has demgnated representative m hereby
authorized to execute the written contract which shall be attached hereto, provided that the written
contract as m accordance with the terms, eond~tlons, spemficataons, standards, quantities and
speeffied sums contained in the Bad Proposal and related documents herem approved and accepted
~uQ.T.I.02~ By the acceptance and approval of the above numbered items of the subnutted
bads, the City Council hereby authorizes the expenditure of funds therefor an the amount and m
accordance with the approved bads or pursuant to a written contract made pursuant thereto as
authonzed hereto
