AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PARTIALLY ABANDONING AND
VACATING THREE SIXTY FOOT EASEMENTS THAT EXTENDS FROM STANLEY
STREET, THOMAS STREET AND HILLCREST STREET RECORDED IN VOLUME 408,
PAGE 33,OF THE DEED RECORDS OF DENTON COUNTY, TEXAS, AND DECLARING
AN EFFECTIVE DATE
WHEREAS, the City of Denton has received a request for a partial abandonment of three
60 foot easements, and
WHEREAS, the Clty staff has revmwed the requested abandonment and recommended
approval, and
WHEREAS, the City Council of the City of Denton has determined that the portion of the
easements bemg vacated are no longer needed for pubhc use, and
WHEREAS, the process for determ]mng fmr market value of the pomon of the Utthty
Easement being vacated, as apphcable, pursuant to TEX LOC GOV'T CODE {}272 001 shall be
followed m effectuating tins abandonment, NOW, THEREFORE,
THE COUNCIL OF THE CITY DENTON HEREBY ORDAINS
~ That the port]on of the easements recorded in Volume 408, Page 33 of the
Deed Records of Denton County, Texas and more particularly described in Exhibit "A" and
shown in Exhibit "B" winch are attached hereto and incorporated herein by reference, is vacated
and permanently abandoned as a public easement, to the extent described in Exinblt "A" and
Exinb~t "B"
~ That the interests of the City of Denton in the easement above described is
hereby released and will revert to the owners as provided by law
~ That this ordinance shall become effective immediately upon its passage
and approval

Records of Denton County, Texas, and part of Lots 1 and 2, of the McClendon Properties
Subdivision, an addition to the City and County of Denton, Texas, according to the plat
thereof, recorded m Cabinet J, Page 29 (formerly held in Volume 4, Page 26) of the Plat
Records of Denton County, Texas, also being part of a tract of land described m a deed to
Eagle l~arms, Inc as recorded under County Clerk's File No 99-R0023944 of the Real
Property Records of Danton County, Texas, and being part of Tracts I, II, and IV as
described m Volume 408, Page 33 of the Deed Records of Denton County, Texas, and
being more particularly described as follows
TRACT 1
Being part of said Tract I, a 60-foot wide strip of land, constituting an extension of
Hlllcrest Street, from the north right-of-way of Emery Street across smd Lots 1 and 2 of
the McClendon Properties Subdivision and smd Eagle Farms tract to the south right-of-
way ofU S Highway 380 (West Umversity Drive)
TRACT 2
Being part of said Tract II, a 60-foot wide strip of land, constituting an extension of
Thomas Street from the north right-of-way of Emcry Street across said 10 053 acre tract
to the south right-of-way ofU S H~ghway 380 (West University Drive)
TRACT 3
Being part of said Tract IV, a 60-foot wide strip of land, constituting an extension of
