AN ORDINANCE ACCEPTING COMPETITIVE BIDS AND AWARDING A PUBLIC WORKS
CONTACT FOR THE PAINTING OF FUEL OIL TANKS, GENERATOR HOUSING, AND
TRANSFORMERS AT THE MUNICIPAL POWER PLANT, PROVIDING FOR THE
EXPENDITURE OF FUNDS THEREFOR, AND PROVIDING AN EFFECTIVE DATE (BID
2480 - PAINTING FUEL OIL TANKS, GENERATOR HOUSING, AND TRANSFORMERS
AWARDED TO PATRICK BROTHERS PAINTING CONTRACTORS IN THE AMOUNT OF
$61,284)
WHEREAS, the City has soheited, received and tabulated competitive bids for the
construction ofpubhc works or improvements m accordance with the procedures of STATE law and
City or&nantes, and
WHEREAS, the City Manager or a designated employee has received and recommended that
the herein described bids are the lowest responsible bids for the construction o£ the pubhc works or
improvements described m the bid invitation, bid proposals and plans and specifications therein,
NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
~ That the following competitive bids for the construction of public works or
improvements, as described in the "Bid Invitations", "Bid Proposals" or plans and spemficataons on
file in the Office of the City's Purchasing Agent filed according to the bid number assigned hereto,
are hereby accepted and approved as being the lowest responsible bids

~ That the acceptance and approval of the above competitive bids shall not
constitute a contract between the City and the person submitting the b~d for construction of such
pubhc works or improvements herem accepted and approved, until such person shall comply with
all requirements specified in the Notice to Bidders including the timely execution of a written
contract and furnishing of performance and payment bonds, and msurance certificate after
notification of the award of the bid

contracts for the performance of the construction of the public works or improvements In accordance
with the bids accepted and approved herein, provided that such contracts are made in accordance
w~th the Notice to B~dders and B~d Proposals, and documents relating thereto specifying the terms,
cond~Oons, plans and spemficat~ons, standards, quantities and specffied sums contmned therein
~ That upon acceptance and approval of the above competitive b~ds and the
execution of contracts for the pubhc works and maprovements as authorized hereto, the City Council
hereby authorizes the expenditure of funds m the manner and in the amount as specified ~n such
approved b~ds and authorized contracts executed pursuant thereto
~ That tlus ordinance shall become effective anmedtately upon ~ts passage and
approval

AN ORDINANCE AMENDING ORDINANCE NO (2000-141 ) BY CANCELING THE AWARD
OF BID 2480 TO PATRICK BROTHERS PAINTING CONTRACTORS AND IN LIEU
THEREOF AWARD THE PUBLIC WORKS CONTRACT FOR THE PAINTING OF FUEL
TANKS AT THE MUNICIPAL POWER PLANT, BID 2547 TO A-AGAPE CONTRACTING
INC IN THE AMOUNT OF $74,369, AND PROVIDING AN EFFECTIVE DATE (BID 2547 -
PAINTING OF FUEL TANKS, GENERATOR HOUSING AND TRANSFORMERS AWARDED
TO A-AGAPE CONTRACTING INC IN THE AMOUNT OF $74,369)
WHEREAS, on April 18, 2000, per Ordinance No ,~Z00l/d~ll') the City Council awarded a
contract to Patrick Brothers Pmntmg Contractors for painting of fuel tanks, generator housing and
transformers m the mount of $61,284, and
WHEREAS, Patrick Brothers defaulted under such contract and was unable to provide
insurance and bonding, Patrick Brothers Painting Contractors has been notified and has accepted
termination of the contract, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That the contract with Patrick Brothers Pmntlng Contractors regarding Bid
2480 is cancelled and in lieu thereof Ordinance No (2000-141) is amended and such contract is
awarded to A-Agape Contracting Inc (Bid 2547) in the amount of $74,369, and the expenditure of
funds is hereby authorized
SECTION II That this ordinance shall become effective immediately upon its passage and
approval
