2000-151 ORDINANCE NO ~gTg7/~--/~-/ AN ORDINANCE OF THE CITY OF DENTON, TEXAS AUTHORIZING THE CITY MANAG]~R TO SUBMIT A GRANT APPLICATION AND ALL OTHER NECESSARY DOCUMENTS TO OBTAIN A GRANT UNDER THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT LEAD-BASED PAINT HAZARD CONTROL GRANT PROGRAM, ESTABLISHING OBJECTIVES AND PROJECTED USE OF FUNDS AND A LEAD-PAINT HAZARD CONTROL PROGRAM DESCRIPTION WITH APPROPRIATE CERTIFICATIONS, AS AUTHORIZED AND REQUIRED BY THE HOUSING AND COMMUNITY DEVELOPMENT ACT OF 1974, AS AMENDED AND ALL OTHER APPLICABLE LAWS, PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the City of Denton, Texas, is concerned with the development of viable urban communities including decent housing, a suitable living environment and expanded economic opportunities, and WHEREAS, the City of Denton, Texas, has a special concern for persons of low and very low income, and WHEREAS, the City of Denton, Texas, as a CDBG entitlement city, wmhes to apply for and obtan a grant of approximately $1 million under the Lead-Based Pant Hazard Control Grant Program, ,under Section 1011 of the Residential Lead-Based Hazard Reduction Act of 1992 (Title X of the Housing and Community Development Act of 1992) and all other applicable laws, and WHEREAS, in applying for this grant, the C~ty of Denton, Texas, intends to comply with Section BI of the Housmg and Urban Development Act of 1968, 12 U S C 1701(u) and will provide tlanlng, employment and other economic opportunity for low and very low income persons (Os defined m 24 C F R 135 5) and for busmess concerns which provide economic oppomunty for low and very low raceme person, and WHEREAS, the primary goal for the Lead-Based Pamt Hazard Control Grant Program is to reduce the exposure of young children to lead-based pant hazards in their home, and WHEREAS, if the City of Denton, Texas, obtans fun(hng - through ~ts Department of Communlty Development - It will develop a lead-based program, a portion of which will be to pursue partnerships with the Denton County Health Department Nursing Services D~v~slon to admunste[ blood level lead testing and to prowde education with the Denton Independent School District for referral of"at nsk" children not currently bemg tested, and WHEREAS, the City of Denton, Texas has met or will meet all citizen parhclpatlon requirements, if any, mcludlng the holding ofpubhc heanngs, and !~rlEREAS, the Residential Lead-Based Hazard Reduction Act of 1992 mentioned above, th~ Commnmty Development Act of 1974, the National Affordable Housing Act of 1990, as amended, require an application and appropriate certification and the City Council deems it in the public interest to authorize the City Manager to make application for this Grant, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION 1 That the City Council of the City of Denton, Texas, authorizes the City Manager to s~gn and submit to the United States Department of Housing and Urban Development and all appropriate offimals thereof, a grant application, all necessary certifications, grant agreements and other documents as well as appropriate assurances for entitlement of funds under the Housing and Commumty Development Act of 1974, as amended, and the National Affordable Housing Act of 1990, as amended, and all other apphcable laws, as necessary, to obtain a grant under the Lead-Based Paint Hazard Control Grant Program SECTION 2 That the City Council of the City of Denton, Texas, anthonzes the Director of Planning and Development to handle all fiscal and administrative matters relating to the application and the administration of the Grant Program if it is funded and all other matters connected therewith SECTION 3 That the City Secretary IS hereby authorized to furmsh true, complete and correct copies of tNs ordinance to all interested parties SECTION 4 That this ordinance shall become effective immediately upon its passage and approval PASSED AND APPROVED this the /r~'t~ day of ~ ,2000 JAC M~.~g~5 I~fi~YOR ATTEST JENNIFER WALTERS, CITY SECRETARY APPR"OVED AS TO LEGAL FORM HERBERT L PROUTY, CITY ATTORNEY BY Page 2 of 2
