2000-166v \share&dept~LGL\Our Documents\Ordmances\00\Juneteenth 3 year doc ORDINANCE NO AN ORDiNANCE OF THE CITY OF DENTON, TEXAS, GRANTING, PURSUANT TO SECTION 20-1(c)(2) OF THE CODE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, AN EXCEPTION TO THE LIMITATIONS IMPOSED BY THAT SECTION WITH RESPECT TO HOURS OF OPERATION OF AN AMPLIFIED LOUDSPEAKER SYSTEM, AND PROVIDING AN EFFECTIVE DATE WHEREAS, pursuant to Section 20-1(c)(2) of the Code, Denton Parks and Recreation Department has made apphcanon to the City Council for an exception to the provmon of that same sectlon restricting the operatxon of amphfied loudspeakers after 10 00 p m, m connection wah the Juneteenth Celebration activities annual event held at 613 Lakey Street, Fred Moore Park, and in connection with smd request, has requested the exception to be granted on an ongoing basra for said annual event at smd location for two days between June 12 and June 26 of each year, and WHEREAS, upon prior apphcatmn and approval by the City Council of the City of Denton, Texas, Denton Parks and Reereatlun Department has consistently demonstrated over the past three years an abdlty to responsibly operate amplified loudspeakers m connection with Juneteenth Celebration Activities annual event held at 613 Lakey Street, Fred Moore Park, at t~mes past the hours defined in §20-1(c)(2) of the Code, w~thm the public interest and without materially disturbing persons of ordinary senmbdlnes m the ~mmethate vlmmty thereof, and WHEREAS, based upon this past history, the City Council of the City of Denton, Texas finds that, granting an exception for this annual event on an ongmng basis for a three-year period, subject to the restnetmns contained heron, would serve the pubhc interest, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS ~ That, pursuant to §20-1(c)(2) of the Code of Or&n,_ances Denton Parks and Recreatmn Department m hereby granted an exception to thru section s 10 00 p m hmltatlon upon the operatmn of amplified loudspeakers, subject to the conditions lasted below 1 Tins exception m granted only m connection with the operanon of the Juneteenth Celebration Aenwnes annual event at 613 Lakey Street, Fred Moore Park, for two days between June 12 and June 26 of each year 2 Denton Parks and Recreation Department agrees to take full responmbihty for ensunng that the conditions of thxs exception are met, and to take all reasonable measures necessary to avoxd &sturbmg persons of ordinary senmblht~es an the ~mmedmte vic~mty of the event I~ \shared\degt~LGL\Our Documents\Ordinances\00xJuneteenth 3 year doc 3 Denton Parks and Recreation Department agrees to cease using amphfied loudspeakers at 12 00 mldmght Monday through Thursday, 1 00 a m Friday and Saturday and 11 00 p m on Sunday 4 Under no mrcumstances shall the annual event employ the use of amphfied loudspeakers between the hours of 1 00 a m and 7 00 a m 5 This ordinance confers no personal or property rights, and may be amended, modffied, superseded or revoked m whole or m park at the wall of the C~ty Council of the C~ty of Denton, Texas, w~thout any advance warning, heanng or compensation, for any reason at all, or for no reason 6 Thru ordinance shall be strictly construed as an excepUon granted pursuant to §20-1(c)(2) of the Code of Ordinances of the C~ty of Denton, Texas The City of Denton, Texas expressly reserves unto itself and all other persons any and all legal remedms, mvfl or cnlmnal, relating to excessive nmse ~n connection w~th this annual event, and hereby dmelmms any promissory or eqmtable estoppel which m~ght ~n any way ~mpede the pursmt of such remedies by any person ~ That thas ordmance shall become effective ~mmedmtely upon ~ts passage and approval, and expire three years hence, unless sooner repealed, modffied or rescinded PASSED AND APPROVED th~s the /~LZ~ day of ~t~J~ , 2000 MAYOR ATTEST~ JENNIFER WALTERS, CITY SECRETARY HERBERT L PROUTY, CITY ATTORNEY
