AN ORDINANCE PROVIDING FOR THE EXPENDITURE OF FUNDS FOR EMERGENCY
PURCHASE OF REPAIRS REQUIRED DUE TO FIRE DAMAGE TO THE SPENCER
STATION, #3 COOLING TOWER IN ACCORDANCE WITH PROVISION OF STATE LAW
EXEMPTING SUCH PURCHASES FROM REQUIREMENTS OF COMPETITIVE BIDDING,
AND PROVIDING AN EFFECTIVE DATE (PURCHASE ORDER 05460 TO MIDWEST
TOWERS, INC IN THE AMOUNT OF $316,538)
WHEREAS, state law and ordinance reqmre that certmn contracts requmng an
expenditure or payment by the C~ty m an amount exceeding $15,000 be by competmve b~ds,
except ~n the case of pubhc calamity where ~t becomes necessary to act at once to appropriate
money to reheve the necessity of the c~tlzens of the c~ty, or ~n case of unforeseen damage to
pubhc property, machinery or equipment, and,
WHEREAS, the C~ty Manager has recommended to the C~ty Council that ~t ~s necessary to
purchase goods or semces due to the following emergency conditions outhned m the memorandum
attached hereto, mcorporated hereto by reference, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
~ That the City Council hereby determines that there ~s a pubhc calamity
that makes it necessary to act at once to appropriate money to reheve the necessity of the cmzens
of the city, or to prowde for unforeseen damage to pubhc property, machinery or eqmpment, and
by reason thereof, the following emergency purchases of materials, equipment, supphes or
serwces, as described m the "Purchase Orders" referenced here~n and on file ~n the office of the
Purchasing Agent, are hereby approved

6" basin joists, 2" x 6" m~dbay nailers, 2" x 4" jo~st supports and 4" x

6 STRUCTURAL REPAIRS
Our first concern ~s to safely remove all fire damaged mechamc,~l
equipment as they pose the greatest r~sk due to their extreme
weight Professionals should accomplish th~s as soon as possible
to prevent their falling and causing further damage
Replace as necessary all Redwood structural members damaged
by fire Again, th~s w~ll be a precarious endeavor g~ven the
conditions for scaffolding and safely replacing certain member',
Although we have completed numerous projects s~rn~lar to th~s

7 FAN DECK
