AN ORDINANCE APPROVING THE EXPENDITURE OF FUNDS FOR THE ANNUAL
CONTRACT FOR THE PURCHASE OF BIOXIDE, A PRODUCT AVAILABLE FROM ONLY
ONE SOURCE 1N ACCORDANCE WITH THE PROVISIONS OF STATE LAW EXEMPTING
SUCH PURCHASES FROM REQUIREMENTS OF COMPETITIVE BIDS, AND PROVIDING
AN EFFECTIVE DATE (FILE 2515 - AWARDED TO U S FILTER AT $1 85 PER GALLON
ANNUAL ESTIMATE USAGE 28,000 GALLONS OR $51,800)
WHEREAS, Seetmn 252 022 of the Local Government Code prowdes that procurement of
atems that are only avmlable from one source, including, 1terns that are only avmlable from one
source because of patents, copyrights, secret processes or natural monopohes, films, manuscripts or
books, electnmty, gas, water and other utility purchases, captive replacement parts or components
for eqmpment, and hbrary materials for a pubhc hbrary that are available only from the persons
holding exclusave dastnbutaon rights to the materials, need not be submitted to compet~twe bads, and
WHEREAS, the Caty Cotmcfl washes to procure one or more of the items mentioned m the
above paragraph, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That the following purchases of materials, eqmpment or supphes, as described
~n the "File 2515" referenced herren and on file an the office of the Purchamng Agent, are hereby
approved

SECTION II That the acceptance and approval of the above ~tems shall not constitute a
contract between the Caty and the person submitting the quotatmn for such atems until such person
shall comply w~th all reqmrements specified by the Purchasing Department
SECTION IH That the Caty Manager is hereby authorized to execute any contracts relating
to the ~tems specified an Sectaon I and the expenditure of funds pursuant to said contracts as hereby
authorized
SECTION IV That th~s ordinance shall become effective ammedmtely upon ~ts passage and
approval
