2000-218S~OUe OOeumenubNi~umw~~06640-0O1 Eoe ORDINANCE NO aooo - a l O AN ORDINANCE OF THE CITY OF DENTON, TEXAS, PROVIDING FOR A DETAILED PLAN FOR 1 19 ACRES LOCATED WITHIN PLANNED DEVELOPMENT (PD-5) ZONING DISTRICT, THE SUBJECT PROPERTY BEING THE PROPERTY GENERALLY LOCATED AT THE SOUTHEAST CORNER OF UNIVERSITY DRIVE AND BONNIE BRAE STREET, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, PROVIDING A SEVERABILITY CLAUSE AND AN EFFECTIVE DATE (Z-00-002) WHEREAS, Kwik Industries, Inc, on behalf of John W and Margaret Porter, has applied for an approval of a detailed plan for 1 19 acres located within Planned Development (PD-5), and WHEREAS, on May 24, 2000, the Planning and Zoning Commission concluded a public hearing as required by law, after which a motion to recommend approval of the Detailed Plan was passed with conditions, and WHEREAS, the City Council finds that the change in zoning is consistent with the Comprehensive Plan, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION 1 The Detailed Plan attached hereto and incorporated herein by reference as Exhibit "A" for 1 19 acres located within Planned Development (PD-5), and more particularly described in Exhibit "B", which is attached hereto and incorporated herein by reference, is hereby approved, subject to the following conditions Architectural standards include the following (a) Ground signage shall be limited to one (1) monument sign for both Sites A and B as depicted on the Detailed Plan and incorporated herein by reference as Exhibit "A" (b) Three and a half (3 1/2) foot tall vegetative screening fence at the time of planting shall be provided along the southern boundary of Sites A and B (c) Lighting shall be designed and maintained so as not to shine on or disturb surrounding residential property or to shine and project upward to prevent diffusion in to the night sky (d) The exterior of buildings shall have the same brick and decor as the Kwik Lube building adjacent to the subject property SECTION 2 If any provision of this ordinance or the application thereof to any person or Page 1 of 2 S\Ouro unu= W Iumc~ tluu circumstance is held invalid by any court, such invalidity shall not affect the validity of other provisions or applications, and to this end the provisions of this ordinance are severable SECTION 3 Any person violating any provision of this ordinance shall, upon conviction, be fined a sum not exceeding $2,000 00 Each day that a provision of this ordinance is violated shall constitute a separate and distinct offense SECTION 4 This ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice in the Denton Record-Chronicle, a daily newspaper published in the City of Denton, Texas, within ten (10) days of the date of its passage PASSED AND APPROVED this the citya-day of ~ 2000 EULINE BROCK, MAYOR ATTEST JENNIFER WALTERS, CITY SECRETARY BY (1-'A it APPROVED AS TO LEGAL FORM HERBERT L PROUTY, CITY ATTORNEY BY Page 2 of 2 EXHIBIT A STATE OF TEXFAS XX COUNTY OF DP)NTON XX Whereas Jahn W.
