2000-263AN ORDINANCE VACATING A UTILITY EASEMENT AFFECTING THE SOUTHERN BOUNDARIES, BLOCK 3, LOTS 1-13 OF HANNAH ESTATES, AN ADDITION TO THE CITY OF DENTON, TEXAS, ACCORDING TO THE PLAT THEREOF, RECORDED IN CABINET C, PAGE 381 OF THE PLAT RECORDS OF DENTON COUNTY, TEXAS AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the C~ty of Denton has received a request for the abandonment of a certmn utlhty easement, and WHEREAS, the Development Rewew Committee of the C~ty of Denton, Texas reviewed the requested abandonment and recommended approval, and WHEREAS, the Council of the City of Denton, Texas has determined that the utlhty easement being vacated is no longer needed for pubhc use, and WHEREAS, the fmr market value of the utthty easement has been determined and received, as required by section 272 001 of the Texas Local Government Code, NOW THEREORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION 1 A 16 foot wide utthty easement along the southern boundaries of Block 3, lots 1 through 13 of Hannah Estates, an addition to the C~ty of Denton, Texas, accor&ng to the plat thereof recorded ~n cabinet C page 381 of the Plat Records of the Denton County, Texas (the "Easement"), is permanently vacated, abandoned, and ext~ngulshed as a pubhc easement SECTION 2 By reason of such vacation the City of Denton's property interest ~n the Easement shall, by operation of law, revert to the owner or owners abutting the easement herein abandoned, and the City of Denton releases any and all claims to the use of the vacated property as a public easement SECTION 3 This ordinance shall become effective ~mme&ately upon ~ts passage and approval PASSED AND APPROVED this the/~2~day of ~ ,2000 EULINE BROCK, MAYOR ATTEST JENNIFER WALTERS, CITY SECRETARY VED AS TO LEGAL Fg~VI HERB~~_I ATTORNEY Page 2
