CONTAINED IN ORDINANCE NO 99-298, AMENDING THE INSUFFICIENT FUND CHECK HANDLING CHARGE, AMENDING THE ELECTRIC AND WATER RECONNECTION FEE IN ORDER TO PROVIDE FOR WATER METERS, PROVIDING FOR A PdEPEALER, PROVIDING FOR A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION 1 That the schedule of fees and charges for general uhhty who requests a reading of a city meter due to a contested bflhng more than twice in the prewous 12 months, and no error ~s found FEE Per Additional Reading $20 00 METER TESTING APPLICATION Applicable to any customer who requests the testing of a city meter previously tested w~th~n the past four years and the meter is found to be wlthtn accuracy standards FEE Per Test $25 00/KWH Electric Meter $35 00/KW/KWH Electric Meter ACCURACY STANDARDS A meter is defined as w~ttun accuracy standards when found to be plus or m~nus two percent (2%) or less Page 3 MISCELLANEOUS FEES, CHARGES, AND DEPOSITS (Effective 10/01/00) INSUFFICIENT FUND CHECK HANDLING CHARGE APPLICATION Apphcabl¢ when a customer's or taxpayer's check for payment of fees, fines, court costs, taxes, utdit~es, or other charges has been dashonored by the maker's bank and returned to the City of Denton unpmd FEE Per Check $25 00 SERVICE DEPOSITS APPLICATION Applicable when a customer requests utility service for the first t~me ~n the City of Denton service area and does not have 12 months of good credit standing with Denton or another utility system for the type of service requested, or does not have a co-signer w~th 12 months of good credit standing with Denton or another electric utility system FEE Residential Customer $150 00 or an mount equal to 1/6 of the last 12 months of billing at the serwce location If Utdlty service ~s disconnected for non- payment, then the customer will be reqmred to pay a deposit sum equal to 1/6 of the last 12 months of billing Commermal Customer $300 00 or an amount equal to 1/6 of the last 12 months of bdhng at the service location, whmhever ~s greater Deposits will earn interest for the customer The rate of ~nterest will be adjusted semi-annually to equal the interest rate of a one year United States Treasury Note on October 1 and April 1 of each year If refund of deposit ~s made within thirty (30) days of receipt of deposit, no interest payment will be made If the City retmns the deposit more than thirty (30) days, payment of interest shall be made retroactive to the date the depom was prod A Payment of the interest to the customer shall be made at the t~me the deposit is returned or credited to the customer's account Page 4 B The deposit shall cease to earn interest on the date it is returned or credited to the customer's account INTEREST EARNED ON CONTRACT RETAINAGE Contract rettunage will earn interest for the contractor as provided by TEX REV CIV STAT ANN Article 6252, See 5b (Vernon Supp 1992) The rate of interest will be adjusted semi- annually to equal the interest rate of a one year United States Treasury Note on October 1 and April 1 of each year Payment of the interest shall be made at the time the retamage is ptud to the contractor CREDIT CARD SERVICE FEE APPLICATION Applicable when payment for fees, fines, court costs, taxes, utilities or other charges are made with a "Discover" credit card RATE/SERVICE CHARGE Payment Amount Service prowsions of this ordinance became effective which are ~nconsxstent, or ~n conflict wxth the terms or prows~ons, contained m this ordinance are hereby repealed to the extent of any such conflmt SECTION 3 That ff any section, subsection, paragraph, sentence, clause, phrase or word in this ordinance, or apphcat~on thereof to any person or circumstances is held mvahd by any court ,of competent junschct~on, such holding shall not affect the vahdxty of the remmmng portions of this ordinance, and the City Council of the City of Denton, Texas, hereby declares ~t would have enacted such remalmng portions despxte any such invalidity SECTION 4 That flus ordinance shall become effective, charged, and applied to all servmes obcurrmg on and after October 1, 2000, and a copy of said fees and utlht~es, or other charges has been dashonored by the maker's bank and returned to the C~ty of Denton unpatd CHARGE Per Check $25 00 SERVICE DEPOSITS APPLICATION Apphcable when a resadentml customer requests utility servace an the C~ty of Denton servme area and does not have twelve (12) months of good credat standing with the City of Denton or another utility system for the type of serwce requested, or does not have a co-sagner wath twelve (12) months of good credat standing wath the C~ty of Denton, or does not request and demonstrate a passing credit rating through a credit repornng agency Apphcable when a commercml customer does not have twenty-four (24) months of good credat stan&ng w~th the Caty of Denton, or a commermal letter of good credat from another uUhty system Not apphcable when a commercial customer provides an arrevocable letter of cre&t to the Caty of Denton as security for payment CHARGE Resadentml Customer $150 00 or an mount equal to 1/6 of the last 12 months of bflhng at the service locaUon If utility servme as dasconnected for non- payment, then the customer wall be reqmred to pay a deposat sum equal to 1/6 of the last 12 months ofbflhng Commercml Customer $300 00 or an amount equal to 1/6 of the last 12 months of bflhng at the service location, whmhever is greater Deposits will earn interest for the customer The apphcable rate of interest will CHARGE APPLICATION This fee is applicable if the customer (a) cannot provide a satisfactory credit rating through previous service h, story with Denton Municipal Uhhtles or another utthty serwce, or (b) cannot provide the city with a qualified co-signer, and (c) prowdes written authorization for the city to obtmn a credit rating from a credit soume avmlable to the city Charge Charge per credit report $12 00 INTEREST EARNED ON CONTRACT RETAINAGE Contract retamage will earn interest for the contractor as provided by TEX REV CIV STAT ANN Article 6252, Sec 5b (Vernon Supp 1992) The rate of with the terms or provisions contained m this ordinance are hereby repealed to the extent of any such conflict SECTION 3 That if any section, subsection, paragraph, sentence, clause, phrase or word m th~s ordinance, or apphcatlon thereof to any person or c~rcumstances ~s held anvahd by any court of competent jurlsdlct~on, such holding shall not affect the valad~ty of the rema~mng portions of tbas orthnance, and the City Council of the City of Denton, Texas, hereby declares would have enacted such remmmng porhons despite any such ~nvahdlty ~ That this ordinance shall become effectave, charged,
