2000-300 ORDINANCE NO d0fO-~t~) AN ORDINANCE OF THE CITY OF DENTON, TEXAS PROVIDING FOR THE PAYMENT OF AN ADMINISTRATIVE PUBLIC WORKS iNSPECTION FEE TO THE CITY FOR INSPECTION SERVICES PROVIDED BY THE CITY FOR PUBLIC IMPROVEMENTS CONSTRUCTED BY DEVELOPERS RELATED TO PRIVATE DEVELOPMENT, AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, In some instances developers construct public improvements which are related to private development, including without limitation, when such pubhc ~mprovements are required by Chapter 34 of the Code of Ordinances as condition of subdivision approval, and WHEREAS, the C~ty ~neurs adm~mstrative expenses in inspecting such public improvements winch should be properly born by the developer, and WHEREAS, the City Council finds that it is in the public interest to require that the developer/applicant pay to the City an administrative inspection fee equal to 3 5% of the cost to construct such pubhe tmprovements, and WHEREAS, the C~ty Cotmcfl finds that such fee bears a reasonable relat~onsinp to the actual admlmstrattve costs ;ncurred by the City to conduct such inspections, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION 1 An Inspection Fee ~s hereby established in an amount equal to 3 5 % of the cost to construct pubhc ~mprovements by developers, which must be paid to the C~ty by the developer of such development prior to acceptance of the pubhc ~mprovements by the C~ty The cost to construct the pubhc improvements ~s the cost set forth ~n the pubhc improvements agreement between the C~ty and the developer SECTION 2 Th~s ordinance shall become effective immediately from and after ~ts passage and approval d yo, , 000 EULINE BROCK, MAYOR SENDER WALTERS,ICITY SECRETARY APPROVED A~.~O LEGAL FiERBERTI~SPROUTY~ ATTORNEY Page 2 of 2
