2000-318 O IN CE NO AN ORDINANCE LEVYING THE AD VALOREM TAX OF THE CITY OF DENTON, TEXAS, FOR THE YEAR 2000, ON ALL TAXABLE PROPERTY WITHIN THE CORPORATE LIMITS OF THE CITY ON SANUARY 1, 2000, NOT EXEMPT BY LAW, PROVIDING REVENL~S FOR PAYMENT OF CURRENT MUNICIIOAL EXPENSES, AND FOR INTEREST AND S1NK1NG FUND ON OUTSTANDING CITY OF DENTON BONDS, PROVIDING FOR LIMITED EXEMPTIONS OF CERTAIN HOMESTEADS, PROVIDING FOR ENFORCEMENT OF COLLECTIONS, PROVIDING FOR A SEVERABILITY CLAUSE, AND PROVIDING AN EFFECTIVE DATE WHEREAS, after notme of a public heanng on a tax increase was pubhshed ~n accordance w~th the law, on August 29, 2000, the C~ty Council held a pubhc hearing on a proposal to adopt a tax rate of $0 52815 per $100 valuation winch would increase total tax revenues from property on the tax roll by 11 3%, and WHEREAS, at the end of tins pubhc hearing, the C~ty Council passed a resolution setting the tax rate meeting and announcing that ~t would vote on the tax rate at ~ts September 5, 2000 meeting, whmh resolution specffied the t~me and place oftlus mectmg, and WHEREAS, after the public hearing and before the September 5, 2000 meeting, the C~ty Council pubhshed a NoUce of Vote on Tax Rate ~n accordance w~th the law, and WHEREAS, the C~ty Counml deems ~t m the pubhc ~nterest to adopt a tax rate for the 2000 tax year, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION 1 By authority of the Charter of the C~ty of Denton, Texas, and the Laws of the State of Texas, there is hereby lev~ed for the year 2000, on all taxable property sxtuated w~ttnn the corporate hm~ts of the City of Denton on January 1, 2000, and not exempt by the ConsUtut~on and Laws of the State of Texas or by Sections 4, 5, and 6 of tlus ordinance, a tax of $0 52815 on each $100 assessed value of all taxable property Tins tax ~s expected to ~nerease total revenue from properties on the tax roll by 11 3% over 1999 tax revenues SECTION 20fthe total tax, $0 31948 of each $100 of assessed value shall be d~stnbuted to the General Fund of the C~ty to fund maintenance and operation expenchtures of the C~ty SECTION 3 Of the total tax, $0 20867 of each $100 of assessed value shall be &stnbuted to pay the C~ty's debt sermce as provided by Section 26 04(e)(3) of the Texas Property Tax Code SECTION 4 Pursuant to Article VIII, Section 1-b of the Texas ConsUtut~on, and pursuant to the prows~ons of Section 11 13(n) of the Texas Property Tax Code, one-half percent of the assessed value of residential homesteads, or $5,000 of the assessed value of res~denUal homesteads, whichever mount shall be greater, shall be exempt from C~ty ad valorem taxes PAGE 1 ~ Pursuant to Artxcle VIII, Sectxon 1-b of the Texas Consntut~on, $25,000 of the assessed value of ms~denOal homesteads of persons 65 years of age or older shall be exempt from Cxty ad valorem taxes ~ Pursuant to Artxcle VIII, Sectton 1-b of the Texas Constitut~on, $10,000 of the assessed value of residential homesteads of d~sabled persons shall be exempt from C~ty ad valorem taxes ~ For enforcement of the collectxon of taxes hereby lemed, the City of Denton shall have avmlable all rights and remethes provided by law ~ If any sectxon, subsection, paragraph, sentence, clause, phrase or word m flus ordinance, or the apphcatxon thereof to any person or mmumstance xs held invalid by any court of competent junsdmt~on, such holding shall not affect the vahd~ty of the remmnmg po~ons of th~s orthnance and the C~ty Council of the City of Denton, Texas, hereby declares it would have enacted such remmnmg po~ons despite any such mvahdxty SECTION 9 Ttus ordinance shall become effective ~mmedmtely upon ~ts passage and approval PASSED AND APPROVED this the ..U~'-~-~ day of ~ ~ ~&2~~, 2000 EULINE BROCK, MAYOR ATTEST JEN~IFER W~ ALTERS, C~TY SECRETARY HERB~U~TTORNEY BY '~ PAGE 2
