2000-333 ORDINANCE NO ~57-3~.~ AN ORDINANCE PROVIDING FOR THE EXPENDITURE OF FUNDS FOR AN EMERGENCY PURCHASE OF URD ELECTRIC POWER CABLE IN ACCORDANCE WITH PROVISIONS OF STATE LAW EXEMPTING SUCH PURCHASES FROM REQUIREMENTS OF COMPETITIVE BIDDING, AND PROVIDING AN EFFECTIVE DATE (PURCHASE ORDER 07933 - TEMPLE, INC IN THE AMOUNT OF $689,665 00) WHEREAS, state law and ordinance require that certmn contracts requmng an expenditure or payment by the C~ty m an amount exceeding $15,000 be by competitive bids, except in the case of public calamity where xt becomes necessary to act at once to appropriate money to relieve the necessity of the citizens of the city, or m case of unforeseen damage to public property, machinery or eqmpment, and, WHEREAS, the Cay Manager has recommended to the City Council that ~t ~s necessary to purchase goods or services due to the emergency cond~nons outhned in the file of the office of the City's Purchasing Agent which is incorporated herein by reference and is m compliance with the requirements of Subsection 252 022(2) of the Texas Local Government Code, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SBCTION I That the City Council hereby determines that this procurement ~s necessary to preserve and protect the pubhc health and safety of the C~ty's residents, and the following emergency purchases of materials, equipment, supphes or services, as described ~n the "Purchase Orders" referenced hereto and on file the office of the Purchasing Agent, are hereby approved' PURCHASE ORDER VENDOR AMOUNT 07933 Temple, Inc $689,665 00 SECTION II That because of such emergency, the City Manager or designated employee is hereby anthonzed to purchase the materials, equipment, supplies or services as described m the attached Purchase Orders and to make payment therefore ~n the amounts therein stated, such emergency purchases being ~n accordance with the provisions of state law exempting such purchases by the C~ty from the requirements of competitive bids SECTION III Th~s ordinance shall become effective lmmedmtely upon ~ts passage and approval PASSED AND APPROVED th~s the ,~ day of~, 2000 EULINE BROCK, MAYOR ATTEST JENNIFER WALTERS, CI'I~Y SECRETARY APPROVED AS TO LEGAL FORM HERB~L ~~TTORNEY
