AN ORDINANCE APPROVING THE EXPENDITURE OF FUNDS FOR THE ANNUAL
CONTRACT FOR THE PURCHASE OF ZETAG 7878 (FORMERLY PERCOL 778), A
PRODUCT ONLY AVAILABLE FROM ONE SOURCE IN ACCORDANCE WITH
PROViSiONS OF STATE LAW EXERTING SUC. PURCHASES FROM Q REMENTS
OF COMPETITIVE BIDS, AND PROVIDING AN EFFECTIVE DATE (FILE 2568 - AWARDED
TO FORT BEND SERVICES, INC AT 1 36 PER GALLON ANNUAL ESTIMATED USAGE IS
25,000 GALLONS OR $34,000)
WHEREAS, Section 252 022 of the Local Government Code provides that procurement of
~tems that are only avmlable from one source, including, items that are only avmlable from one
source because of patents, copyrights, secret processes or natural monopolies, films, manuscripts or
books, electnmty, gas, water and other utility purchases, captive replacement pans or components
for equipment, and library matenals for a public library that are available only from the persons
holding exclusive distribution rights to the materials, need not be submitted to competitive bids, and
WHEREAS, the City Council wishes to procure one or more of the items mentioned in the
above paragraph, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I That the following purchases of materials, eqmpment or supplies, as described
~n the "File 2515" referenced hereto and on file in the office of the Purchasing Agent, are hereby
approved

SECTION II That the acceptance and approval of the above items shall not constitute a
contract between the City and the person submitting the quotation for such items until such person
shall comply with all reqmrements specified by the Purchasing Department
SECTION III That the Cxty Manager is hereby authorized to execute any contracts relatmg
to the items specified in Section I and the expenditure of funds pursuant to smd contracts is hereby
authorized
SECTION IV That this ordmance shall become effective lmme&ately upon xts passage and
approval

customers, which Included Fort Bend Services, Inc At that hme, Fort Bend Services, Inc deeded not to pass thru
increase on to our customers Recently, we received notEIcetion that as of September 1, 2000, there w~ll be
another rate mcreace and fuel surcharge added
We have also received price increases from our polymer supphers Unfortunately, due to thru upcoming increase
