2000-360 ORDINANCE NO J~2~-~O~) AN ORDINANCE OF THE CITY OF DENTON, TEXAS, AMENDING ORDINANCE 2000-311 TO PROVIDE FOR A DETAILED/PROJECT PLAN FOR 18 2 ACRES LOCATED WITHIN PLANNED DEVELOPMENT 188 (PD-188) ZONING DISTRICT, THE SUBJECT PROPERTY BEING LOCATED AT THE SOUTHWEST CORNER OF HICKORY AND BONNIE BRAE STREET,~PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF $2,000 00 FOR VIOLATIONS THEREOF, PROVIDING A SEVERABILITY CLAUSE AND AN EFFECTIVE DATE (Z-00-014) WHEREAS, on September 5, 2000, by Ordinance 2000-311, the City council approved a Zomng Plan for a change m zoning for 18 2 acres of land to Planned Development 188 (PD-188) Zoning District, and WHEREAS, on June 28, 2000 Ambhng Development Company, on behalf of J Newton Rayzor submitted a Detmled/Project Plan for 18 2 acres of land zoned Planned Development 188 (PD-188) for development of multi family residences, and WHEREAS, on August 23, 2000, the Planning and Zoning Commission concluded a pubhc hearing as required by law, after which a motion to recommend approval of the Detailed/ProJect Plan passed, and WHEREAS, the City Council finds that the Detmled/Project Plan is consistent with the approved Zomng Plan for PD -188, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION 1 OrdmanccNo 2000-311 prowdmgfortheapprovalofaPlannedDevelopment Zoning Dlstnct Classification and Use Designation for the property described as PD-188 is amended by approving the Detmled/Project Plan attached hereto and incorporated here~n by reference as Exhibit B for 18 2 acres located at the southwest comer of H~ckory and Bonnie Brae (Lot 1, Block A, Umverslty Courtyard Addmon), more particularly described by the legal description attached hereto and incorporated herein by reference as Exhibit A, subject to the following conditions 1 The project plan/detailed plan shall be rewsed to include the same stone pavers at the northern driveway on Bonnie Brae, as are shown on the detmled landscape plan 2 The masonry of the proposed monument signs shall be of the same masonry proposed for the braidings 3 Add a note to the plan that states "Based on current reqmrements on median property to the west of the subject property ~s developed SECTION 2 The provisions of this ordinance as they apply to the 18 2 acres shown in the Detailed/Project Plan hereto approved shall govem and
