2000-366 ORDINANCE NO ~ AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AN. INTERLOCAL AGREEMENT WITH THE CITY OF CARROLLTON'S RELATING TO PARTICIPATION OF THE CITY OF DENTON 1N THE CITY OF CARROLLTON CONTRACT WHICH PROVIDES FOR THE PURCHASE OF OFFICE SUPPLIES AND SIMILAR MATERIAL, AND DECLARING AN EFFECTIVE DATE (FILE 2565 - INTERLOCAL AGREEMENT WITH CITY OF CARROLLTON) THE COLrNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION 1 That the City Manager is hereby authorized to execute an Interlocal Agreement in substantially the same form as the one attached hereto and incorporated by reference herein for the purchase of office supplies and related matermls from an annual contract awarded by the City of Carrollton and on file in the office of the City Purchasing Agent SECTION 2 That the City Manager is authorized to expend funds pursuant to the agreement for the purchase of various goods and services SECTION 3 that this ordmanee shall become effective immediately upon its passage and approval PASSED AND APPROVED tins the ~ day of t/~"~.~ ,2000 EUL1NE BROCK, MAYOR ATTF~ST JENNIFER WALTERS, CITY SECRETARY APPROVED AS TO LEGAL FORM FBILYE2565-1NTERL¢CALAO~EEMENTWI(''''~'~-/~f~r~ / ~'~ TH THE CITY OF CARROLLTON INTERLOCAL AGREEMENT THIS AGREEMENT made and entered into tins 5~ day of September, 2000, by and between the CITY OF CARROLLTON, TEXAS (hereinafter called "Carrollton") and the CITY OF DENTON, TEXAS (hereinafter called "Denton"), acting through the CITY OF CARROLLTON duly authonzed agent WITNESSETH WHEREAS, the city of Carrollton and the City of Denton as permitted under Chapter 791 of the Texas Government Code, the Interlocal Cooperation Act, wish to enter into tins Interlocal Agreement to set forth the terms and conditions upon which the city of Carrollton and the city of Denton may purchase various goods and services commonly utilized by smd entities, and WHEREAS, pameipation in a Cooperative Purchasing Program will be highly beneficial to the taxpayers of the city of Carrollton and the city of Denton through the anticipated savings to be realized, NOW, THEREFORE, in consideration of the foregoing and the mutual promises, covenants and obligations as set forth herein, the city of Carrollton and the city of Denton agree as follows 1 Pamcipants will work cooperatively to provide a program for the purchase of various goods and sermcas commonly utilized by all participants ("Cooperative Purchasing Program"), and under such Program may purchase goods and services from vendors under present and future contracts 2 Participants wtll enter into individual contracts with vendors under the Cooperative Purchasing Program provided for under this Agreement The participants shall be individually responsible for payment directly to the vendor and for the vendor's compliance wrth all conditions of delivery and quality of purchased items under such individual contracts 3 The city of Denton may purchase goods and services pursuant to Section 791 025 of the Texas Government Code 4 This Agreement shall be in effect from the date of execution until terminated by either party to the ,agreement 5 Notwithstanding anyttnng herein to the contrary, pammpation in this Agreement by the City may be tenmnated upon thmy (30) days written notice to the other member 6 The clty of Denton, in paying for the performance of governmental functions or services, must make those payments from current revenues available to the paying party ,) 00003 EXECUTED HERETO ON THE DAY AND YEAR FIRST WRITTEN ABOVE CITY OF CARROLLTON, TEXAS CITY OF DENTON, TEXAS Gary Jag(kson, C~lt~ ManXa~er MiChael ~V Jez{Clty~/~er Approved as to form .~ ~, ~<?yApproved as to content By aulhori~y of Council Acc,on Dated~, 000033
