AN ORDINANCE AMENDING SECTION 26-126 1 OF THE DENTON CODE OF ORDI-
NANCES TO REQUIRE THAT NO WASTEWATER TAP FEE WOULD BE REQUIRED
UNDER CIRCUMSTANCES WHERE A TAP FEE WAS NOT REQUIRED PRIOR TO THE
ENACTMENT OF THE TAP FEE REGULATIONS, RATIFYING PREVIOUS ACTIONS,
REQUIRING THE PROPERTY OWNER TO PRESENT EVIDENCE CONCERNING THE
CIRCUMSTANCES, PROVIDING A SAVINGS CLAUSE AND AN EFFECTIVE DATE
WHEREAS, a property owner - Mr Roosevelt Washington - has requested the waiver of
a wastewater tap fee for the property located at 523 Ruth Street, and
WHEREAS the City Council deems it in the public interest to reqmre that no wastewater
tap fees shall be reqmred to be prod under mmmnstances s~mllar to the s~tuat~on at 523 Ruth
Street where previously there were no requirements for wastewater tap fees to be prod when
wastewater service had been provided m the past, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION 1 That Section 26-126 1 "Installation of taps by utthty department" Chapter
26 "Utilities" of the Code of Ordinances of the C~ty of Denton ~s hereby amended by ad&ng a
new subsection (f) wtuch shall read as follows
(f) Wastewater tap fees waived under certam circumstances Upon the pres-
entatlon of satisfactory ewdence by the property owner to the C~ty,
through its D~rector of Water/Wastewater Uttht~es, that a resident had
multiple wastewater service where two or more residences had servme on
a single hne prior to enactment of tap fees and the Utility Department de-
cides to serve the properties on multiple hnes under circumstances that
will promote redevelopment of the property, no additional wastewater tap
fees may be charged against the property owner
SECTION 2 That save and except as amended hereby, all the sections, subsections,
paragraphs, sentences, clauses and phrases of Section 26-126 1 and Chapter 26 of the Code of
Ordinances of the Caty of Denton shall remain ~n full force and effect
SECTION 3 That any action by the C~ty Manger or the D~rector of Water/Wastewater
Utilities m colmectlng wastewater serwce to the property at 523 Ruth Street or ~ssumg certffi-
cares of occupancy are hereby retroactively approved
SECTION 4 That this ordinance shall become effective ~mmed~ately upon ~ts passage
and approval
