2000-439AN ORDINANCE OF THE CITY OF DENTON, TEXAS, AMENDING CHAPTER 33 OF THE CODE OF ORDINANCES, CITY OF DENTON, TEXAS, AMENDING SEC 33-2, PROVIDING FOR DEFINITION OF SANDWICH BOARD SIGN, AMENDING SECTION 33-4, PROVIDING FOR THE ALLOWANCE OF SANDWICH BOARD SIGNS IN THE CENTRAL BUSINESS DISTRICT, AMENDING SEC 33-184, PROVIDING FOR THE STANDARDS FOR SANDWICH BOARD SIGNS, PROVIDING FOR A PENALTY IN AN AMOUNT NOT TO EXCEED FIVE HUNDRED DOLLARS, AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the Central Bus~ness D~stnct ~nclude the h~stonc downtown square which is listed m the National Register of Hlstonc Places, and WHEREAS, most of the sidewalks in the Central Business District are wider than sidewalks in other areas of the C~ty of Denton, and WHEREAS, historically sandwich board or "A" frame s~gns were allowed on the sidewalks of the city during the period reflected by the historic architecture of the downtown square, and WHEREAS, allowing sandwich board or "A" frame s~gns will promote the continued historic accuracy of the central business district by reducing the need for more modem advertising mechanisms NOW THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION 1 That Section 33-2 of Chapter 33, Code of Ordinances, City of Denton, Texas ~s amended by adding the definition as follows Sandwtch board or "A "frame stgn is a portable s~gn, consist~ng of two panels of equal s~ze, made of painted, decay-resistant wood, whmh are hinged at the top and placed on the ground or pavement so as to be self-supporting SECTION 2~ That Section 33-4(4) of Chapter 33, Code of Or&nances, City of Denton, Texas ~s amended to read as follows (4) &gns on pubhc property Any sign located on or attached to a public street light, utility pole, hydrant, bndge, traffic control device, street s~gn or other pubhc structure or bmldlng, or any sign, other than a stake sign, located in, on, over, or w~th~n a pubhc street, sidewalk, alley easement or right-of-way This prohibition shall not apply to projecting signs or sandwmh board or "A" frame signs ~n central bus~ness (hstncts as permitted by this article, markings made on pubhc sidewalks as permitted by the Code of Ordinances, or wind device s~gns placed over a public street by the c~ty of advenase annual community events SECTION 3 That Section 33-184 of Chapter 33, Code of Ordinances, City of Denton, Texas ~s amended to read as follows Sec 33-184. Central business districts. The following regulations shall apply to s~gns m central bus~ness zoning districts (a) Type Ground, wall, roof, temporary, w~nd dewce, projecting, and sandwich board or "A" frame s~gns are penmtted ~n central business districts (b) Effective area and height No ground or roof s~gn shall have an effective area greater than sixty (60) feet, and no ground sign shall have a height greater than slx (6) feet (c) Right-of-way hm~tatlon on projecting signs No projecting signs shall project or extend into the public nght-of-way for a distance of more than ten (10) feet or wathln two (2) feet of the nearest curbhne, whichever is more restrictive No projecting sign, supporting structure or part thereof whmh extends ~nto the public right-of-way shall occupy any of the space between the ground level and e~ght (8) feet above the ground level in the right-of-way (d) Sandwich board s~gns or "A" frame s~gns must conform to the following regulations (1) Maxamum s~gn height shall be three (3) feet (2)Maxamum algn w~dth shall be two (2) feet and signs shall not be placed in front of adjoining property and no portion of the sign shall extend more than three (3) feet from the braiding face (3) Signs must be properly anchored (temporarily) or weighted agmnst the wind (4) A m~nlmum clear sidewalk width of forth-eight (48) inches shall be mmntmned (5) Chalkboards may be used for dally changing messages and no changeable letter on tracks may be used (6) S~gns shall be designed and constructed so as to promote and not visually obscure the slgmficant architectural features of the National Register D~stnct and its bmldlngs (7) S~gns must be removed after business hours (8) No other portable s~gns are permitted (9) Sidewalks must be at least ten (10) feet wide ~n order to erect or maintain a sandwich board or "A" frame s~gn (10) Permits fees for applications, renewals, alterations, and vanances shall be set by city council as for other signs in this chapter Apphcatlons for sandwich board or "A" frame signs must be approved by the City of Denton Historic Preservation Officer before the issuance of a permit and all apphcatlons must be submitted for Officer approval at least fourteen (14) days prior to installation (11) Permits for sidewalk or "A" frame signs shall be valid for the location designated on the apphcation for one (1) year Permits may be transferred to another owner after payment ora transfer fee set by city council (12) Any variance to the reqmrements for sandwich board or "A" frame s~gns will be handled the same as any other s~gn variance The Board of Adjustment in cons~denng any variance request regarding sandwich board or "A" frame signs shall consider any recommendation made by the H~storlc Landmark Commission regarding the application SECTION 4 That any person molat~ng any provisions of this ordinance shall, upon conviction, be fined a sum not exceeding $500 00 Each day that a proms~on of this ordinance ~s violated shall constitute a separate and distract offense SECTION 5.
