AN ORDINANCE AMENDING ARTICLE III OF CHAPTER 28 OF THE CODE OF
ORDINANCES OF THE CITY OF DENTON, TEXAS, "ELECTRICAL CODE" BY
REPEALING THE 1996 NATIONAL ELECTRICAL CODE WITH CERTAIN
AMENDMENTS AND PROVIDING FOR THE ADOPTION OF THE 1999 NATIONAL
ELECTRICAL CODE WITH CERTAIN DELETIONS AND AMENDMENTS, PROVIDING
FOR A SEVERABILITY CLAUSE, PROVIDING FOR A REPEALER CLAUSE,
PROVIDING FOR A PENALTY IN THE AMOUNT OF $2000 OO FOR VIOLATIONS
THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE
THE CITY COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION 1. That Section 28-61 of Article III of Chapter 28 of the Code of Ordinances
of the City of Denton, Texas, is hereby amended to read as follows
See 28-61. Adoption of electrical eerie.
The 1999 National Electrical Code as published by the National F~re Protection Association, a
copy of which shall be filed with the office of the C~ty Secretary and available for public
inspection, is hereby adopted and designated as the electrical code of the city, the same as
though that echtlon of such code were cop~ed at length here~n, subject to deletions and
amendments enumerated in Section 28-62
SECTION 2. That Section 28~62 of Artmle III of Chapter 28 of the Code of Ordinances
of the C~ty of Denton is hereby amended to read as follows
Sec. 28-62. Deletions and Amendments
The Nataonal Electrical Code adopted by Sectmn 28-61 is amended as follows
(1) Section 230-2(a) is amended by adding a sixth Special Condmon to read as follows
(6) In supplying electrical sermce to multlfamlly dwelhngs, two or more laterals or
overhead service drops shall be permitted to a building when both of the following
conditions are met
a The building has slx or more individual gang meters and all meters are
grouped at the same location
b Each lateral or overhead service drop originates from the same pmnt of
service
(2) Section 230-71(a) ~s amended by adding an exception to read as follows
Exception: Multi-occupant Bmldlngs Indlmdual service dlscormectmg means 18
hmlted to slx for each occupant The number of individual dlscormects at one location
may exceed slx
(3) Section 250-50 is amended by adding a ilfth paragraph to read as follows
Where a metal underground water p~pe, as described in ~tem (a) Is not present, a
method of grounding as specified m (b) through (d) below shall be used
(4) Section 250-104(b) is amended to read as follows
(b) Metal Gas Piping. Each interior portion of a metal gas piping system upstream
from the eqmpment shutoff valve shall be electrically cont~unous and bonded to the
grounchng electrode system The bonding jumper shall be s~zed in accordance with
Table 250-122 using the rating of the clrcmt that may energize the gas piping
(5) Section 310-15(b)(6) is amended to read as follows
(b) Tables
(6) 120/240-Volt, 3-Wire, Single-Phase Dwelhng Services and Feeders. For
dwelhng units, conductors, as listed in Table 310-15(b)(6) shall be (text
unchanged) conductors The grounded conductor shall be permitted to be smaller than
the ungrounded conductors, provided the reqmrements of Sections 215-2, 220-22 and
230-42 are met Th~s Section shall not be used m conjunction with Section 220-30
(6) Section 336-5(a)(1) is amended by adding an exception to read as follows
Exception: An additional level shall be peruntted in multlfamfly dwelhngs where the
entire structure is protected throughout by an approved automatic spnnkler system
(7) Section 336-5(a) is amended by adding a tenth restriction to read as follows
(10) In non-resldentml metal frame structures
~ That ~f any provision of th~s ordinance or apphcat~on thereof to any
person or circumstance is held mvahd, such mvahd~ty shall not affect other prowslons or
apphcatxons, and to flus end provisions of th~s ordinance are severable
~That all prowmons of the orchnances of the C~ty of Denton in conflict w~th
the proms~ons of this ordinance are hereby repealed, and all other provls~ons of the ordinances
of the City of Denton, not in conflict with the provisions of this ordinance, shall remain m full
force and effect
SECTION 5 That any person wolat~ng any provxs~on of tins ordinance shall, upon
conwct~on, be fined a sum not to exceed two thousand dollars ($2000 00) Each day that a
prows~on of tins ordinance is v~olated shall constitute a separate and distract offense
~ That tins ordinance shall become effective fourteen (14) days from the
date of ~ts passage, and the C~ty Secretary is hereby directed to cause the caption of tins
ordinance to be pubhshed twice ~n the Denton Record-Chromcle, the official newspaper of the
City of Denton, Texas, w~thln ten (10) days of the date of~ts passage
