AN ORDINANCE OF THE CITY OF DENTON, TEXAS, AMENDING THE DETAIL PLAN FOR
A PORTION OF PLANNED DEVELOPMENT (PD-6) ZONING DISTRICT CLASSIFICATION
AND USE DESIGNATION BY INCREASING THE MAXIMUM BUILDING SQUARE
FOOTAGE ALLOWED IN THE EXISTING DETAIL PLAN, BEING 3 24 ACRES OF LAND
LOCATED ON THE EAST SIDE COLORADO BOULEVARD, APPROXIMATELY 525 FEET
NORTH OF LOOP 288, PROVIDING FOR A PENALTY IN THE MAXIMUM AMOUNT OF
$2,000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, Barry R Kmght, on behalf of Golden Triangle Joant Venture, has apphed for
a change m zoning for 3 24 acres of land to change the maximum allowed square footage on a detml
plan an a portaon of Planned Development (PD-6) zomng d~stnct classffieataon and use desagnat~on,
and
WHEREAS, on December 16, 1998, the Planmng and Zoning Commission recommended
approval of the requested change an zomng, and
WHEREAS, the Caty Council finds that the change in zomng will be an comphance w~th the
1988 Denton Development Plan and the 1998 Denton Plan Pohcles, NOW, THEREFORE
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
~ That the zomng d~stnct classification and use designation of the 3 24 acre
property described m the legal description attached hereto and ancorporated hereto as Exlubat A m
amended by adopting a new detml plan as attached hereto and ~ncorporated herem as Exbab~t B
whmh allows a max~mtun square footage of 39,000 w~thm Planned Development (PD-6) zomng
d~stnct classfficat~on and use desagnataon under the comprehensave zomng ordanance of the Caty of
Denton, Texas voth the following ad~tlonal condition
Lighting on the property shall be desagned and mmntalned so as not to sh~ne on, or
otherwise dtsturb, adjmmng property or to shine and project upward to prevent
diffusion mto the mght sky
~ That the Caty's of~clal zomng map as amended to show the change m zoning
district classification
~ That any person vaolatmg any provmon of th~s ordinance shall, upon
convmtmn, be fined a sum not exceeding $2,000 00 Each day that a prowsaon of this ordinance ~s
wolated shall constitute a separate and d~st~nct offense
~ That flus orchnance shall become effective fourteen (14) days from the date
of ats passage, and the C~ty Secretary ~s hereby chrected to cause the captaon of flus ordinance to be
pubhshed tvace ~n the Denton Record-Chromcle, a dmly newspaper pubhshed in the City of Denton,
Texas, within ten (10) days of the date of as passage
~ That Planned Development 6, as amended, shall remain m full force and
effect, save and except as amended by tins Ordinance
