1999-032 O INANCENO AN ORDINANCE OF THE CITY OF DENTON, TEXAS AMENDING AND ADOPTING THE SCHEDULE OF FEES AS AUTHORIZED BY CHAPTER 34 AND CHAPTER 35 OF THE CODE OF ORDINANCES FOR THE CITY OF DENTON, TEXAS, FOR FILING APPLICATIONS FOR REVIEW, APPROVAL, GRANT OR ISSUANCE OF PLATS, PLANS, LICENSES, CERTIFICATES, VARIANCES OR DESIGNATIONS REQUIRED BY THE SUBDIVISION RULES AND REGULATIONS AND ZONING REGULATIONS OF THE CODE OF ORDINANCES; PROVIDING FOR REPEAL OF ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SEVERABILITY CLAUSE, PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Caty Council of the City of Denton, Texas has amended the City Code, Chapter 34 "Subthvmon and Land Development Regulations" and Chapter 35 "Zomng" to ~mprove public heanng notfficatson procedures for annexations, zoning changes, zoning variances, appeals, and special exceptions, and WHEREAS, the City Cotmml has determined that the cost of public heanng notification should be borne by the applicants and petitioners makang apphcatlons requesting annexations, zoning changes, zoning variances, appeals, and special exceptions, and WHEREAS, the City Council now intends to exercise ~ts authority under Section 34-10 "Fees" and Section 35-7(c) "Filing Fees" by ad&ng the costs of rural and sign notfficatlon to the Development Review Fee Schedule, and WHEREAS, the City Council has conducted a pubhc heanng on the proposed regulations contained hereto, NOW THEREFORE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I. That the Development Review Fee Schedule set forth m Exlublt "A", attached hereto and made a part hereof for all purposes, ~s hereby adopted and authorized to be ~mposed for the filing of applications, rewew, approval, grant or issuance of plats, plans, permits, licenses, certificates, variances or designations required by the Subdlvmon Rules and Regulations and Zomng Regulations set forth and authorized ~n Chapters 34 and 35 respectively of the Code of Ordinances of the City of Denton SECTION II. That tbas ordinance shall repeal every prior ordinance an conflict herewith, but only xnsofar as the portxon of such prior ordinance shall be m conflmt, and as to all other sectmns of the ordinance not an &feet conflict herewith, this ordinance shall be and is hereby made cumulative except sections of the orthnance not m direct conflact herewith, thas ordJnance shall be and is hereby made cumulaUve except as to such prior ordinances or portions thereof as are expressly repealed hereby ~ That af any promsaon oftlus ordinance or apphcataon thereof to any person or mmumstance as held invalid by any court, such holdang shall not affect the vahdaty of the remmmng portaons of tlus ordinance, and the City Council of the City of Denton, Texas, hereby declares that at would have enacted the remmmng portaons despite any such validity ~ That this orchnance shall become effective fourteen (14) days from its passage, and the City Secretary as hereby chrected to cause the caption of this ordinance to be published twace an the Denton Record-Chromcle, a daffy newspaper published in the City of Denton, Texas, w~thm ten (10) days of the date ofats passage PASSED AND APPROVED on this the ~/~ day of ~, 1999.
