1999-056AN ORDINANCE ORDERING AN ELECTION TO BE HELD IN THE CITY OF DENTON, TEXAS, ON MAY 1, 1999, AND, IF A RUNOFF ELECTION IS REQUIRED, ON MAY 29, 1999, FOR THE PURPOSE OF ELECTING COUNCILMEMBER8 TO PLACES 1, 2, 3 AND 4 OF THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS, DESIGNATING VOTING PLACES AND APPOINTING ELECTION OFFICIALS, PROVIDING FOR BILINGUAL NOTICE OF THE ELECTION, ORDERING THAT AN ELECTRONIC VOTING SYSTEM BE USED, MAKING ADDITIONAL PROVISIONS FOR THE CONDUCT THEREOF, PROVIDING AN OPEN MEETINGS CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That a mumcxpal elect~on ~s ordered to be held m the City of Denton, Texas, on Saturday, May 1, 1999, such date being aumform elect~on date as defined m Tex Elec Code §41 001, as mended (the "Code") for the purpose of electing Cotmmlmembers for Places 1, 2, 3 and 4 In the event a runoffm required, the nmoff electaon shall be held on Saturday, May 29, 1999 That all those provisions ~n tlus ordinance for designating electaon officials, polling places, and describing other election procedures shall be ~ncorporated ~n an ordinance calhng a City Charter amendment electron passed on or about the same t~me as flus ordinance SECTION II That the polhng places, wbach shall be open from 7 00 a m to 7 00 p m, shall be as follows 1 Voters residing m D~stnct No 1 shall vote at MARTIN LUTHER KING, JR RECREATION CENTER 1300 WILSON STREET DENTON, TEXAS 2 Voters residing in D~stnct No 2 shall vote at FIRE STATION NO 4 2110 SHERMAN DRIVE DENTON, TEXAS 3 Voters residing m D~stnct No 3 shall vote at NORTH LAKES RECREATION CENTER 2001 WEST WINDSOR DRIVE DENTON, TEXAS 4 Voters reslrhng ~n D~stnct No 4 shall vote at DENIA RECREATION CENTER PAGE 1 1001 PARVIN DENTON, TEXAS SECTION IH That the election officials for the elect~on and the rtmoff, if any, shall be as follows 1 For the Central Counting Station George Spuller, Presiding Judge, Don Alexander, Manager, and Randle Srmth, Tabulation Superwsor 2 For District No 1 Ruby Cole, Presldmg Judge and , Alternate Judge 3 For Dlsmct No 2 Dons Cinpman, Presiding Judge and Mary Mecay, Alternate Judge 4 For District No 3 Bill Wllhamson, Presiding Judge and Karen Pitman, Alternate Judge $ For Dlsmct No 4 , Pres~chng Judge and Joyce Snay, Alternate Judge 6 Jennifer Walters, City Secretary, shall conduct early voting under the Texas Election Code 7 George Spuller shall be Presiding Judge for the Early Ballot Board The presiding judge of the Central Counting Station and of each district are anthonzed to appoint a,suffielent number of clerks as necessary to assist them in the election, including bilingual assistants as reqmred by law The rate of pay/'or electionjudges and clerks shall be the maxnnum amount prowded for by State law ~ That early voting shall be conducted for the election, and the runoff election if necessary, by the Office of the City Secretary m the Mummpal Bmldlng at 215 East MeKlnney Street in ~e C~ty of Denton, Texas The polls for early votmg by personal appearance shall be open between the hours of 8 00 am and $ 00 pm Monday through Friday, commencing on Apnl 14, 1999, and ending on April 27, 1999 In adchtion, early voting shall be held on Saturday, April 17, 1999, between the hours of 10 00 a m and 3 00 p m, at the same location as weekday early voting ~ That the Mayor as hereby d~rected to provide notice of the election, and the runoff election if necessary, in accordance with Sections 4 002 and 4 003 of the Texas Election Code, the nolace to be pnnted m the Spamsh language and the Enghsh language ~ That an eleotromc votang system, using optacally scanned ballots, meeting the reqmrem~nts of Chapter 124 of the Code, shall be used for smd election Preparation of the necessary eqmpment and officml ballots for the election shall conform to the reqmrements of the Texas Electron Code PAGE2 SECTION VII That the City Secretary is authonzed to prepare the official ballot for the election and perform every act reqmred by the C~ty Charter and laws of the State of Texas for holdtng elect~ons ~ The elect~on officers named above shall make returns for the elect~on in the manner reqmred by law The ballots that are properly marked ~n conformance with the prows~ons of the Texas Elect~on Code for votes cast both dunng the period of early voting and on the day of the elect~on shall be counted m the manner mqmred by law SECTION IX. That the manner of holding such election and all questions pertmmng thereto shall be governed by the elect~on laws of the State of Texas SECTION X Substantial cop~es of this ordinance in both Enghsh and Spamsh shall serve as proper notme of the election and smd notace shall be (a) pubhshed at least once ~n a newspaper of general c~rculat~on pubhshed w~thln the C~ty, not less than the thirtieth day or later than the tenth day before the electron, (b) posted, not later than the twenty-first day before the electron day, at a public place m each election dastnct that ~s m the jurisdiction of the city, (c) posted, not later than the twenty-first day before elect~on day, on the bulletin board used for posting notices of meetings of the C~ty Council of the City, and (d) posted, as may other~v~se be reqmred by Tex Elec Code §4 003 and other apphcable law SECTION XI.
