HARDWARE AND SOFTWARE UPGRADE FOR Y2K COMPLIANCE AVAILABLE FROM ONLY
ONE SOURCE IN ACCORDANCE WITH THE PROVISIONS OF STATE LAW EXEMPTING SUCH
PURCHASES FROM REQUIREMENTS OF COMPETITIVE BIDS, AND PROVIDING AN EFFECTIVE
DATE (PURCHASE ORDER 92698 PROCESS ANALYSTS, INC, CIRRUS SOFTWARE
AGREEMENT, IN THE AMOUNT OF $46,300)
WHEREAS, Sectton 252 022 of the Local Government Code provides that procurement of
items that are only avmlable fi.om one source, including, items that are only available fi.om one
source because of patents, copyrights, secret processes or natural monopohes, films, manuscripts or
books, electricity, gas, water and other utility purchases, captive replacement parts or components
for eqmpment, and hbrary materials for a public hbrary that are avtulable only fi.om the persons
holding exclumve d~stnbutmn rights to the materials, need not be subnutted to competitive bids, and
WHEREAS, the C~ty Council wishes to procure one or more of the ~tems mentioned ~n the
above paragraph, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS
SECTION I. That the followmg purchase of materials, equipment or supplies, as described
in the "Purchase Orders" attached hereto, are hereby approved

SECTION II That the acceptance and approval of the above items shall not constitute a
contract between the C~ty and the person subm~tttng the quotation for such items until such person

SECTION IH That the Clty Manager ~s hereby authorized to execute any conlracts relating
to the ~tems specffied m Section I and the expenditure of funds pursuant to sand contracts ~s hereby
authorized
SECTION IV That flus ordinance shall become effecUve unmedmtely upon ~ts passage and
approval
