AN ORDINANCE OF THE CITY OF DENTON,I ?EXAS, PROVDING FOR A CHANGE FROM
SINGLE FAMILY (SF-7) ZONING DISTRICT I 'LASSIFICATION AND USE DESIGNATION
TO NEIGHBORHOOD SERVICES (NS) ZON] D DISTRICT CLASSIFICATION AND USE
DESIGNATION FOR A 22 ACRE TRACT O~ ILAND LOCATED AT 615 DALLAS DRIVE,
LOCATED ON THE SOUTHEAST CORNE~. OF CHAMBERS AND CLIFTON WITH
FRONTAGE ON DALLAS DRIVE, PROVID: NG FOR A PENALTY IN THE MAXIMUM
AMOUNT OF $2,000 00 FOR VIOLATIO~ THEREOF, AND PROVIDING FOR AN
EFFECTIVE DATE
WHEREAS, D L (Chip) Sargent, Jr, on ~alf of Matthew A Gohlke, has applied for a
change in zonmg for a 22 acre tract of land fi.om ingle Family (SF-7) zoning district elassfficatlon
and use designation to Neighborhood Servic (NS) zomng district classification and use
designation, and
WHEREAS, on February 24, 1999, the mnmg and Zomng Commission recommended
approval of the requested change in zoning, and
WHEREAS, the City Council finds that ti ~ change in zomng will be in compliance with the
1988 Denton Development Plan, the 1998 Dento~ Plan Policies, and the 1999 Growth Management
Strategy, NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON 1 EREBY ORDAINS
SECTION I That the zoning district cna tfieatlon and use designation of the 22 acre tract
of land described in the legal descnpUon attach~ [ hereto and incorporated herein as ExtuNt A is
changed fi.om Single Family (SF-7) zomng~ tlstnct elassfficatlon and use designation to
Neighborhood Services (NS) zomng dlstnet~ :lasmfication and use designation under the
comprehensive zomng ordinance of the City of 13 ~nton, Texas, subject to the following conditions
1 Lighting on the property shall be designed a~ id mamtmned so as not to shine on, or otherwise
disturb, adjmmng property or to shine and prc eot upward to prevent the diffusion into the mght
sky
2 There shall be promded a buffer yard along tl ~northemandeastemboundarythatlsatleastl0
feet wide with one (1) canopy tree per 25 hne ' feet and one (1) understory tree for every canopy
tree There shall also be a privacy screening ,race provided in the eastern buffer yard
3 There shall be provided a screening hedge ng the northern boundary, having an installation
height of 18" or greater, growing to a mlnlmt mature height of 36", and spaced no more than
24" apart, edge to edge
4 Development shall be consistent w~th the sul rotted site plan (Exhibit B)
SECTION II That the City's official zm ag map is amended to show the change in zomng
dlsmct classification
SECTION III That any person vlolat] any provision of this ordinance shall, upon
conviction, be fined a sam not exceechng $2,000 Each day that a provision ofth~s orthnance is
violated shall constxtute a separate and chstlnct o nsc
SECTION IV That th~s orthnance shall' ~come effective fourteen (14) days f~om the date
of its passage, and the City Secretary is hereby & ~cted to cause the caption of tlus ordinance to be
pubhshed twice in the Denton Record-Chromcle, l dmly newspaper pubhshed in the C~ty of Denton,
Texas, wahln ten (10) days of the date of~ts pass ,ge
