1999-119I~ \shared\dept~LGL\Our Documents\Ordmances\99\Umform Plumbmg Cgde Ordinance doc NO. 0 0-//9 ORDIN^NCE AMENDING A T CLE IV OF CritTER 28 OF THE COOE OF ORDINANCES OF THE CITY OF DENTON, TEXAS, ("PLUMBING CODE") BY REPEALiNG THE 1985 UNIFORM PLUMBING CODE WITH CERTAiN AMENDMENTS AND PROVIDiNG FOR THE ADOPTION OF THE 1997 UNIFORM PLUMBING CODE WITH CERTAIN DELETIONS AND AMENDMENTS, PROVIDING A SEVERABILITY CLAUSE, PROVIDING A SAVINGS CLAUSE, PROVIDING FOR A PENALTY IN THE AMOUNT OF $2000 00 FOR VIOLATIONS THEREOF, AND PROVIDING FOR AN EFFECTIVE DATE THE CITY COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION I That Section 28-144 of Article IV of Chapter 28 of the Code of Ordinances of the City of Denton, Texas, is hereby amended to read as follows Sec. 28-144 Adoption of plumbing code. The 1997 Uniform Plumbing Code, and appendices A through L thereto, as published by The International Association of Plumbing and Mechanical Officials, a copy of which shall be filed with the office of the City Secretary and av0alable for public inspection, is hereby adopted and designated as the plumbing code of the city, the same as though that e&tlon of such code were copied at length herein, subject to the deletions and amendments enumerated in Section 28- 145 SECTION II That Section 28-145 of Ar~icle IV of Chapter 28 of the Code of Ordinances of the City of Denton is hereby amer~ded to read as follows Sec. 28-145. Deletions and Amendments The following Sections of the plumbing code adopted by Section 28-144 are amended to read as indicated below (1) 103 4 1, Permit Fees 103 4 1 is amended to read as follows The applicant shall submit the applicable pemut fee as set forth by City Colmclt by separate ordinance, avmlablo for public inspection at the offices of the Bml&ng Official and the City Secretary (2) Table 1 1, Plumbmg Permit Fees Table 1 1 is deleted (3) Section 405 2, Connections Section 405 2 is deleted (4) Section 514 1 Section 514 1 shall be amended to read as follows Connectors used for gas water heaters having draft hoods may be constructed of noncombustible materials having resistance to corrosion not less than that of galvanized sheet steel and shall be,of Type B or Type L vent material (5) Sectton 514 2 Section 514 2 shall be deleted (6) Section 514 3 Section 514 3 shall~ be deleted (7) Section 516 5 Section 516 5 shall be deleted (8) Sectton 603 4 4, Heat Exchangers, Section 603 4 4 is amended by adding a paragraph 603 4 4 3 to read as follows It shall be unlawful for any person to connect or allow a heat exchanger to remmn connected to any potable water system if the heat exchanger returns water to the public or private water system (9) Sectton 604 1 Section 604 1 shall be amended to read as follows Water pipe and fittings shall be brass, copper, cast iron, galvanized malleable iron, galvanized wrought iron or galvanized steel Schedule 40 PVC and AWWA C900 piping having the national Sanitation Foundation seal followed by the letters "PW" may be used for cold water distribution systems outside of buddings All materials used in the water supply system, except valves and similar devices, shall be of a like material, except where otherwise approved by the bmldmg official (I0) Section 608 5 Section 608 5 shall be amended to read as follows Relief valves located inside a building shall be provided with a drain not smaller than the relief valve outlet, of galvanized steel, or hard drawn copper piping and fittings, and shall extend from the valve to the outside of the building, not less than three (3) feet to any paved ~urface, with the end of the pipe not more than two (2) feet nor less than SlX (6) inches above ground and pointing downward Such drains may terminate at other locations when approved by he adnnmstratlve authority No part of such drain pipe shall be trapped and the terminal end of the drmn shall not be threaded (11) $ectton 612, Shut-Off Valve Section 612 shall be amended by adding the following paragraph to read as follows A shut off valve shall be installed in an approved box located adjacent to each building The shut offvalve shallmot be placed in any paved area and may not be located in the public right-of-way (12) $ectton 719 ! Section 719 1 shall be amended to read as follows PAGE Cleanouts shall be placed ~nslde,~the bml&ng near the connection between the bulldmg dram and the bmldmg sewer or installed outside the bmldmg at the lower end of the bmldmg drain and extegded to grade One (1) ad&t~onal cleanout shall be ~nstalled at the property line and connected to the bml&ng sewer ~n such a manner that ~t w~ll facilitate downstream access of the stol or waste (13) Sectton 1014 1 Section 1014 1: shall be amended by adding the following paragraphs to read as follows '~ Minimum construction standards for food servme estabhshments are reqmred when 1 A new bmldlng is construeted and occupied 2 Prior to the ~ssuance of a Certfficate of Occupancy for an existing bml&ng which has not been prev~otlsly used as a food servme estabhshment within the last SlX (6) months Heavv Food Prenaratlon shall mean any area ~n which foods are prepared utilizing a grill, griddle, deep-fat fryer, commermal type ovens, and/or any s~mllar food preparation equipment, or any area subject to floo&ng type or wet cleaning procedures due to the cutting or processing of meat, poultry, fish or pork Heavy food preparation includes but ~s not hmlted to cafeterias, fast food restaurants, full service restaurants, pizza Ereparatlon, donut preparation, meat and fish markets, (et cetera) A mlnlmumll000 gallon grease ~nterceptor is required for a heavy food preparation establishments Ll~,ht Food PreDaratlon. shall mean any area ~n which foods are prepared exclusive of the use of fryers, grills, or other s~mdar eqmpment L~ght food preparation ~s usually hm~ted to the preparation of hot dogs, sandwiches, salads, or other similar foods and fouOtam-type cold dnnks L~ght food preparation Includes, but ~s not hnnted to, sar)~ dwmh shops, hmlted menu concession stands, (et cetera) A mlmmmn 200 gallon grease ~nterceptor ~s reqmred for a hght food preparation establishments NO Food Preparation shall mean any area in whmh foods are provided prewrapped, from an approved source, w~th m~crowave oven type heating being the maximum handling involved, No food preparation ~s hm~ted to pre-packaged sandwiches or s~mdar foods, c~,&es and contmnenzed beverages A grease mterceptor is not reqmred for a nO food preparation establishments (14) Sectton 1014 4 Section 1014 4 shall be amended by deleting paragraphs one and two in their entirety (15) Table 10-2 Table 10-2 ~s deleted (16) Sectton 1206 3 Section 1206 3 ~ amended by ad&ng the following paragraph to read as follows PAGE 3 It shall be unlawful for the gas service to be turned on in any bml&ng which has been damaged by fire without fi~st obta~mng a plumbing permit and testing the gas piping in accordance with this icode SECTION III That if any provision of Lhls ordinance or the appbcatmn thereof to any person or c~rcumstance is held invalid, such ~nvahdlty shall not affect other prowslons or applications, and to this end the provisions of this ordinance are severable SECTION IV That all provisions of the ordinances of the City of Denton in conflict with the provlsmns of this or&nance are hereby repealed, and all other provisions of the ordinances of the City of Denton, not in conffict with the provisions of this ordinance, shall remmn ~n full force and effect SECTION V That any person violating any prowsmn of this ordinance shall, upon conviction, be fined a sum not to exceed two lthousand dollars ($2000 00) Each day that a provision of this 0rdmance is violated shall constitute a separate and distinct offense SECTION VI That this ordinance shall become effective fourteen (14) days from the date of its passage, and the City Secretary is hereby directed to cause the caption of this ordinance to be published twice m the Denton Record-Chronicle, the official newspaper of the City of Denton, Texas, within ten (10) days ofth~ date of its passage PASSED AND APPROVED this the/~_~day of (~,~102-~ .~ , 1999 J~MILLER, MAYOR ATTEST JENNIFER WALTERS, CITY SECRETARY APPR~'OVED AS TO LEGAL FO~ HE~ERT L PROUTY, CITY ATTO~Y PA~E 4
