1999-151 ORDINANCE NO q~-/ff/ AN ORDINANCE APPROVING THB EXPENDITURE OF FUNDS FOR THE PURCHASE OF LIFEPAKiDEFIBRILLATORS, MONITORS AND PERIFERIAL ITEMS, AVAILABLE FROM ONLY ONE SOURCE 1N ACCORDANCE WITH THE PROVISIONS OF STATE LAW EXEMPTING SUCH PURCHASBS FROM REQUIREMENTS OF COMPETITIVE BIDS, AND PROVIDING AN EFFECTIVE DATB (PURCHASE ORDER 94106 - PHYSIO-CONTROL CORPORATION, FOR LIFBPAK 12 AND LIFEPAK 10 DEFIBRILLATORS, MONITORS AND PERIFERIALS IN THE AMOUNT OF $84,319) WHEREAS, Section 252 022 of the Local Government Code prowdes that procurement of ~tems that,are only available from one source, melud~ng, ~tems that are only avmlable from one source because of patents, copyrights, secret processes or natural monopohes, films, manuscripts or books, electricity, gas, water and other utility purchases, captive replacement parts or components for eqmpment, and hbrary materials for a pubhc hbrary that are avadable only from the persons holding e~clusxve dmtnbut~on rights to the materials, need not be submitted to competitive Nds, and WHEREAS, the C~ty Councd w~shes to procure one or more of the ~tems mentmned ~n the above paragraph, NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS SECTION L That the following purchase of materials, eqmpment or supphes, as described ~n the "PuJ~ehase Orders" attached hereto, are hereby approved PURCHASE ORDER yENDOR AMOUNT 94106 PHYSIO-CONTROL CORPORATION $84,319 SI~CTION II That the acceptance and approval of the above ~tems shall not constitute a contract between the C~ty and the person submitting the quotatmn for such ~tems until such person shall comply w~th all reqmrements specffied by the Purchasing Department SECTION III That the C~ty Manager ~s hereby authorized to execute any contracts relating to the ~ten~s specffied ~n Section I and the expenditure of funds pursuant to smd contracts ~s hereby authonze~t SECTION IV That thru ordinance shall become effective ~mmechately upon ~ts passage and approval JAC~ ATTEST JENNIFER WALTERS, CITY SECRETARY APPROVED AS TO LEGAL FORM HERBERT L PROUTY, CITY ATTORNEY
