INTENT AND APPLICATION OF TEXAS UTILITIES ELECTRIC COMPANY HERETOFORE FILED WITH THE CITY ON JANUARY 15, 1999, SUCH SUSPENSION BEING SET FORTH IN ORDINANCE NUMBER 99-058, PROVIDING FOR APPROVAL OF RATE SCHEDULES FOR TEXAS UTILITIES ELECTRIC COMPANY RESPECTING TIME- OF-USE RATE OPTIONS PERTAINING TO THE SALE OF ELECTRIC SERVICE TO RESIDENTIAL, COMMERCIAL, AND INDUSTRIAL CUSTOMERS WITHIN ITS DULY- CERTIFICATED AREA IN THE CITY OF DENTON, TEXAS, PROVIDING CONDITIONS UNDER WHICH SUCH RATE SCHEDULES MAY BE CHANGED, MODIFIED, AMENDED OR WITHDRAWN, FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE IS PASSED IS OPEN TO THE PUBLIC AS REQUIRED BY LAW, ADOPTING DECLARATIONS AND FINDINGS IN THE PREAMBLE, AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, on January 15, 1999, Texas Utdatles Electric Company (hereinafter referred to as "TU Electric") filed wath the City Councd, beang the govemang body of the Caty of Denton, a Home-Rule City, proposed new rate schedules that provade ad&taonal rate options for ~ts customers, which options are entarely voluntary on the part of the customer, namely ats proposed Rate GTU-M - General Service Tame-of-Use-Munlcapahty, proposed Rate RTU1-M Residential Time-of-Use Servace-Mtm~capahty, and proposed rate GTUC-M - General Sermce Time-of-Use Voluntary Curta~lable-Munlc~pallty (smd three proposed new rate schedules are hereanafter collectively referred to as the "Tame-of-Use Rate Schedules") WHEREAS, the C~ty Councal, after initially cons~denng the proposed "Tame-of-Use Rate Schedules", enacted Ordanance No 99-058 on February 16, 1999 whmh suspended the proposed rate changes for a period of ninety (90) days, as permatted by Section 36 108(a) Texas Utlht~es Code, V T C A (1997), until May 20, 1999, in order to make a reasonable determination of all relevant factors ~nvolved w~th the proposed rates and to awmt the determanat~on and approval of the Public Utdatles Commission of Texas ("PUC") an Docket No 17942 Thereafter, on April 14, 1999, the PUC entered its Order in Docket No 17942, and made Fandmgs of Fact and Conclusaons of Law respectang the proposed "Tame-of-Use Rate Schedules" The C~ty has determined that the three attached "T~me-of-Use Rate Schedules" ldentffied as [1] Tariff for Electric Servme 3 1 8 Rate RTU1-M - Resadentml Tame-of-Use Servace - Mtmmapallty, [2] Tanff for Electric Service 3 2 25 Rate GTU-M - General Servme Tame-of-Use - Mumcapahty, and [3] Tariff for Electric Servace 3 2 26 Rate GTUC-M - General Servace Tame-of-Use Voluntary Curtmlable - Mumcipahty, should be approved, subject to the provlsaons of thas Or&nance, and that the rate suspensaon described hereanabove should be an all thangs, hfied and termanated, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DENTON, TEXAS HEREBY ORDAINS SECTION I The City Council accordingly hereby lifts and terminates the suspension of the proposed "Time-of-Use Rate Schedules" heretofore enacted by the Council by Ordinance No 99-058, effective this date, SECTION II That all of the declarations and findings contained In the preamble to this ordinance are made a part hereof and shall be fully effective as a part of the ordained subject matter of this ordinance SECTION III The City Council hereby approves the three above-described Time-of-Use Rate Schedules attached hereto and incorporated herewith by reference, and TU Electric is authorized to render service and to collect charges as specified in the Time-of-Use Rate Schedules from its customers electing to receive electric service under said Time-of-Use Rate Schedules within the corporate limits of this municipality until such time as smd rate schedules may be changed, modified, amended or withdrawn with the approval of the City Council SECTION IV The three Time-of-Use Rate Schedules herein approved shall be effective from and after the final passage and approval of this Ordinance SECTION V The filing of said Time-of-Use Rate Schedules shall constitute notice to the consumers of electnmty within the City of Denton, Texas, of the availability and application of such Time-of-Use Rate Schedules SECTION VI TU Electric shall not seek any additional rate or surcharge mechanism in order to recover any revenues lost on account of the application of these time-of-use rates, and there shall be no imputed revenues on account of any reduction m TU Electnc's revenues that may result from the application of these time-of-use rates SECTION VII The rate reductions approved by the Public Utility Commission of Texas in Docket No 18490 shall be applied to the time-of-use rates approved herein, such that Rider RRD shall be applicable to Rate RTU1-M, Rider GSRD shall be applied to all customers taking secondary service under either Rate GTU-M designated as GTU-M-SEC or under Rate GTUC-M designated as GTUC-M-SEC, and Pdder RD shall be applied to all other customers on Rate GTU-M or Rate GTUC-M SI~CTION VIII In its next general base rate case in which the time-of-use rates herein approved are at issue, TU Electric will either (a) include all customers taking service under Rate GTUC or GTUC-M during the test year involved in such base rate case as a separate rate class in ~ts cost allocation study, or (b) include in its cost allocation study the load and revenue data applicable to each GTUC or GTUC-M customer taking service under Rate GTUC or GTUC-M during the test year involved in such base rate case with the load and revenue data of the rate class applicable to such GTUC or GTUC-M customer immediately prior to such customer's taking service under Rate GTUC or GTUC-M In the event, however, that industry restructuring is mandated by legislative changes prior to the time that TU Electric has another general base rate case and such legislation authorizes the recovery by TU Electric of any stranded costs from its various customer classes in accordance with its last approved cost of servme study, the customers then recelwng servme under the t~me-of-use rates will be ~ncluded ~n the customer classes reflected in TU Electnc's most recent cost of servme study as follows (A) Customers on rate RTU1-M shall be ~ncluded m Rate Class RTU, (B) Customers on Rate GTU-M shall be included ~n Rate Class HV, GP, or GS, depending upon the voltage level of the servme, such that customers on Rate GTU-M rece~wng serwce at h~gh voltages shall be included ~n Rate Class HV, customers rece~wng serwce at primary distribution voltages shall be included m Rate Class GP, and customers receiving service at secondary d~stnbutmn voltages shall be included m Rate Class GS, and (C) Customers on Rate GTUC-M shall be included ~n Rate Class NI (Notmed Interrupt~ble) depending upon the voltage level of the service, such that customers on Rate GTUC-M recelwng servme at h~gh voltages shall be ~ncluded m Rate Class NI (H~gh Voltage), customers on Rate GTUC-M receiving service at primary dtstnbut~on voltages shall be ~ncluded ~n Rate NI (Primary), and Customers on Rate GTUC-M recelwng service at secondary d~str~butlon voltages shall be ~ncluded m Rate NI (Secondary) SECTION IX Nothing ~n th~s
